Téma této rigorózní práce je obrana povinného v exekuci se zaměřením na odklad a zastavení exekuce. Práce se týká exekuce prováděné soudními exekutory podle zákona č. 120/2001 Sb., o soudních exekutorech a exekuční činnosti (exekuční řád). Cílem práce je popsat a zhodnotit možnosti obrany povinného, rozebrat aplikační problémy a případně navrhnout úpravu de lege ferenda. K jednotlivým institutům zmiňuji závěry judikatury, která je důležitým zdrojem k výkladu právních norem. Rigorózní práce se skládá ze čtyř kapitol, které se dále člení na jednotlivé podkapitoly. První kapitola je věnována obecně výkladu pojmu a účelu exekuce, pramenům právní úpravy a základním zásadám exekučního řízení. Součástí této kapitoly je i historický exkurs do vývoje exekučního práva v naší zemi a příklad zahraničního postupu při vymáhání pohledávek. Podrobně jsou vysvětleny základní zásady exekučního řízení včetně uvedení příkladů konkrétních zákonných ustanovení, v nichž jsou tyto zásady vyjádřeny. Druhá kapitola se obecně zmiňuje o prostředcích obrany povinného, dobrovolném splnění povinnosti a dále rozebírá jednotlivé prostředky obrany povinného, náležitosti a podmínky jejich realizace. Čtenářům jsou přiblíženy podmínky použití námitky podjatosti soudního exekutora, stížnosti proti postupu soudního exekutora, návrhu na... The topic of this rigorous thesis is the defense of the debtor in execution with the focus on institutes deferral and discontinuance of execution. The thesis concerns execution carried out by the judicial officers according to Act No. 120/2001 Coll., on court executors and execution activities (Execution Procedure Code). The aim of this thesis is to describe and evaluate the possibilities of debtor's defense, to analyze application problems and to propose a modification de lege ferenda. I refer to the conclusions of the judicial decisions to individual institutes, which is an important source for the interpretation of legal rules. This rigorous thesis consists of four chapters, which are further separated into individual subchapters. The first chapter is devoted general interpretation of term and purpose of execution, sources of law and main principles of execution proceeding. This chapter also includes a historical excursion to the development of execution law in our country and an example of a foreign procedure in the exaction of claims. The main principles of execution proceeding are explained in detail, including examples of specific provisions of a statute in which these principles are expressed.
