Tato diplomová práce se zabývá právní analýzou institutu stálé provozovny a rozborem jeho jednotlivých charakteristický znaků. První kapitola této diplomové práce poskytne stručný úvod do problematiky mezinárodního zdanění a představí základní myšlenky stojící za konceptem stálé provozovny. Po teoretickém úvodu následuje historický exkurz do vývoje institutu stálé provozovny od jeho počátků až do jeho současné moderní podoby ve dvacátém prvním století. Druhá kapitola se bude věnovat samotné podstatě a konstrukci institutu stálé provozovny zakotvené v bilaterálních a Modelových smlouvách OECD a OSN. V úvodu bude proto tato kapitola zaměřena na vysvětlení povahy a závaznosti těchto mezinárodních pramenů práva. Následně bude proveden detailní rozbor definice stálé provozovny a její jednotlivých komponentů. Na závěr této části bude provedena komparativní analýza definice stálé provozovny v Modelových smlouvách OECD a OSN. Ve třetí kapitole bude ve stručnosti popsán vztah mezi jednotlivými definicemi stálé provozovny, které lze nalézt v mezinárodních a vnitrostátních právních instrumentech. Následující oddíly této kapitoly budou věnovány institutu stálé provozovny ve vnitrostátních předpisech a bude provedena analýza specifik a odlišností vnitrostátní definice stálé provozovny oproti jejímu znění v... This master's thesis conducts the legal analysis of the concept of a permanent establishment and its individual characteristics. The first chapter of this master's thesis provides a brief introduction to the issue of international taxation and introduces the basic ideas behind the concept of a permanent establishment. The theoretical introduction is followed by a historical excursion into the development of this concept from its beginnings to its current modern form in the twenty-first century. The second chapter deals with the very essence and construction of the concept of a permanent establishment which is enshrined in bilateral tax agreements and the OECD and the UN Model Tax Conventions. Hence, the introduction of this chapter focuses on explanation of the essence and binding nature of these international sources of law. Subsequently, a detailed analysis of the concept of a permanent establishment and its components is conducted. At the end of this chapter a comparative analysis of the definitions of a permanent establishment in the OECD and the UN Model Tax Conventions is conducted.
