Skončení pracovního poměru v ČR a SRN Abstrakt Tato diplomová práce se zabývá problematikou skončení pracovního poměru v České republice a ve Spolkové republice Německo. Cílem této práce je nejprve seznámit čtenáře s právní úpravou skončení pracovního poměru v obou zemích, včetně rozebrání vybrané relevantní judikatury. Těžiště práce spočívá v následném srovnání české a německé právní úpravy skončení pracovního poměru, přičemž práce v tomto ohledu upozorňuje na shodné a rozdílné znaky u jednotlivých způsobů skončení pracovního poměru v těchto zemích a hodnotí obě právní úpravy. Pozornost je dále věnována úvahám de lege ferenda, a to ve vztahu k možnému převzetí některých dílčích úprav z německé právní úpravy do českého právního řádu, jakož i k jiným možným návrhům na změnu českého právního řádu vycházejících z poznatků a závěrů z předchozích částí. Předložená diplomová práce je rozdělena do pěti částí. V první částí je popsáno pracovní právo v České republice a ve Spolkové republice Německo, přičemž důraz je kladen především na systém pracovního práva a prameny pracovního práva v obou právních řádech včetně nastínění jejich historie. Druhá část podrobně pojednává o jednotlivých způsobech skončení pracovního poměru v České republice. Nejprve jsou popsány způsoby skončení pracovního poměru na základě právního... The termination of the employment in Czech Republic and Germany Abstract This thesis pertains to the issue of the termination of employment in the Czech Republic and Germany. The aim of this thesis is to familiarize the readers with the legal framework pertaining to the termination of employment in both countries, including analysis of relevant case law. The main focus of this thesis is the comparison of the Czech and German legal framework of termination of employment. The thesis aims to draw attention to the common and different characteristics of the legal framework of termination of employment in the respective countries and evaluate them. Moreover, the thesis deals with prospective de lege ferenda changes of the Czech legal framework that could be inspired by the applicable German legal framework. Furthermore, other de lege ferenda legislative proposals of the author are discussed in the thesis. This thesis is divided into 5 chapters. The first chapter of the thesis provides an analysis of labour law in the Czech Republic and Germany, whereas emphasis is placed especially on the systematics of the labour law framework and the historical origins of labour law in each respective country.
