Resumé Tématem této práce je posouzení předpokladů pluralismu práva a nestátních právních systémů pro zlepšení možnosti řešení sporů ve společnosti. Hlavní výzkumnou otázkou práce je, zda nestátní právní systémy plní společenskou roli při poskytování spravedlnosti. Práce by měla nabídnout deskriptivní analýzu konceptu legálního pluralismu a metodických postupů pro zahrnutí nestátních právních systémů do státních. Výsledkem práce by měl být přehled o možnostech interakce různých právních systémů ať již formálních či obyčejových, o různých způsobech řešení sporů v tomto prostředí a o přínosu takových návrhů na reformu právního prostředí, které vycházejí z reálné situace ve společnosti. Tato práce se bude v první části nejdříve zaobírat deskriptivní analýzou pojmu legální pluralismus v odborné diskusi a jeho vztahem k nastíněnému tématu, následně porovná metody a postupy legálního pluralismu, respektive fungování nestátních právních systémů, a nakonec shrne implikace analytického konceptu právního pluralismu pro plánování a zlepšování právního prostředí. Dále by se práce zaměřila na prozkoumání důsledků různých přístupů ve vztahu mezi formálními a obyčejovými právními systémy a na specifická témata vlastní těmto příkladům, tedy na aktuální možnosti využití konceptu pluralismu práva, ať již v konkrétních zemích... The theme of this thesis is the assessment of the prerequisites for the pluralism of law and non-state justice systems to improve the possibilities of solving disputes in society. The main research question is whether non-state justice systems fulfil a social role in providing justice. The thesis should offer a descriptive analysis of the concept of legal pluralism and methodological procedures for the inclusion of non-state justice systems in the state. The outcome of the work should be an overview of the possibilities of interaction between different legal systems, whether formal or customary, of the different ways of resolving disputes in this environment, and of the contribution of such proposals to the reform of the legal environment that count on the real situation in society. This work will first deal with a descriptive analysis of the concept of legal pluralism in the professional discourse and its relation to the outlined topic, then compare the methods and procedures of legal pluralism, respectively the functioning of non-state justice systems, and finally summarize the implications of the analytical concept of legal pluralism for planning and improvement of the legal environment.
