Pracovní doba a některé další s ní související instituty zaměstnanců ve zdravotnictví Abstrakt Tato diplomová práce řeší pracovní dobu zaměstnanců pracujících ve zdravotnictví, ovšem vyjadřuje se i k dalším oblastem, které jsou s pracovní dobou spojeny. Je možné v ní najít ucelený přehled platné a účinné právní úpravy, která je doplněna o relevantní evropskou judikaturu vztahující se k právě řešené oblasti. Vedle aktuálního stavu bylo cílem práce také ověřit, zda je právní úprava efektivní a zda je dodržována. Práce je členěna do několika kapitol, přičemž začíná výkladem pracovněprávních zásad a ústředních pojmů celé práce- zaměstnanec a zaměstnavatel ve zdravotnictví. Nejobsáhlejší kapitolou je kapitola věnovaná hlavnímu tématu této práce, a to pracovní době. Je zde rozebrán pojem pracovní doby, její evidence a délky, přičemž nebyl vynechán ani pojem zkrácené a kratší pracovní doby. Další kapitoly se věnují institutům jako je noční práce, práce přesčas, pracovní pohotovost nebo doba odpočinku. V kapitole věnované práci přesčas je rozebráno i její odměňování, jako jediné odměňování v celé této práci, a to proto, že odměny za práci přesčas ve zdravotnictví tvoří velkou část měsíčních odměn a je tedy vhodné na tento fakt poukázat. Doba odpočinku je v této práci naopak zkrácena o právní úpravu dovolené. Na... 1 Working hours and some other related institutions of healthcare workers Abstract This diploma thesis deals with the working hours of workers working in healthcare, but also comments on other areas that are associated with working hours. It is possible to find in it a comprehensive overview of valid and effective legislation, which is supplemented by relevant European case law related to the area currently addressed. In addition to the current situation, the aim of the thesis is also to verify whether the legislation is effective and whether it is complied with. The thesis is divided into several chapters, beginning with an explanation of labor law principles and central concepts of the whole thesis - the worker and the employer in healthcare. The most comprehensive chapter is the chapter devoted to the main topic of this thesis, working hours. The concept of working hours, its records and length are discussed here, while the concept of shortened and shorter working hours was not omitted. Other chapters deal with institutes such as night work, overtime, on-call time or rest periods.
