diplomové práce Výkon autorského práva osobou odlišnou od autora (dědice autora) Téma diplomové práce Výkon autorského práva osobou odlišnou od autora (dědice autora) pojednává o české právní úpravě zaměstnaneckého díla a kolektivního díla z pohledu jejich specifického postavení v české autorskoprávní úpravě vyplývající ze zákonného omezení výkonu výlučných autorských práv majetkových a částečně i omezení výlučných autorských práv osobnostních autora díla, jež zasazuje do širšího kontextu s německou právní úpravou zejména autorského díla vytvořeného zaměstnancem a kolektivního díla a s americkou právní úpravou zvláště autorského díla vytvořeného zaměstnancem pod právním režimem "Work made for hire" a kolektivního díla. Cílem diplomové práce je ukotvit českou právní úpravu v širším pojetí prostřednictvím zahrnutí konzervativní německé právní úpravy vycházející z kontinentálního právního systému a specifické právní úpravy Spojených států amerických příznačné pro angloamerický právní systém. První kapitola vycházející z konceptuálních východisek kontinentálního a angloamerického právního systému začleňuje pojetí autorství, postavení autora a autorského díla v České republice, Německu a Spojených státech amerických. Navazující druhá kapitola vymezuje autorská práva autora založená na konceptuálních... of the diploma thesis The exercise of copyright by a person other than the author (heir of the author) The diploma thesis The exercise of copyright by a person other than the author (heir of the author) deals with the Czech legal framework of a work created by an employee and a collective work in terms of their specific position in the Czech legal framework resulting from the legal restriction of the exercise of the exclusive economic rights of an author and partly the exclusive moral rights of an author of a work within broader context with the German legal framework of a work created by an employee and a collective work, and with the legal framework copyright of the United States of America, especially a work created by employee under the legal doctrine "Work made for hire" and a collective work. The aim of the diploma thesis is to anchor the Czech legislation in a broader sense by including the conservative German legislation based on the continental legal system and by including the legislation of the United States of America symptomatic of the common legal system.
