Tato diplomová práce se zabývá tématem základních zásad přestupkového řízení, přičemž ústřední pozornost je věnována zásadě ne bis in idem (ne dvakrát v téže věci). Cílem práce je představit základní zásady, které by měly najít své uplatnění v přestupkovém řízení, popř. v procesu trestání obecně. Za tímto účelem jsem zvolil metodu analýzy, kdy porovnávám výčet jednotlivých zásad přestupkového (trestního) řízení a jejich obsah podle jednotlivých autorů. Po zjištění, že v doktríně nepanuje shoda na tom, které zásady se v řízení o přestupku mají aplikovat, jsem se pokusil o syntézu těchto rozdílných názorů, a to tak, že jsem vybral jednotlivé zásady, na kterých se většina autorů shoduje, a k nim přidal další zásady, které by se měly v řízení o přestupku uplatnit podlé mého názoru. K jednotlivým zásadám jsem připojil stručný komentář, abych čtenáře uvedl do problematiky. Na základě takto vybraných zásad jsem následně vytvořil unikátní seznam základních zásad přestupkového řízení, tedy zásad, které by se zcela určitě měly v řízení o přestupku aplikovat. Z tohoto výčtu základních zásad přestupkového řízení jsem vybral zásadu ne bis in idem, které jsem věnoval nejvíce pozornosti, neboť uvedenou zásadu lze považovat za nejvíce problematickou. This diploma thesis discusses the topic of the basic principles of offence proceedings, whereas attention is primarily focused on the principle of ne bis in idem (not twice against the same thing). The purpose of this work is to present the key principles that should be applied during an offence proceeding, or during the process of punishment in general. For this purpose I chose the method of analysis, during which I compared a list of individual principles of offence (criminal) proceedings and their content according to individual authors. After establishing that no accord has been reached in this doctrine in regard to which principles should be applied during an offence proceeding, I endeavoured to synthesise these differing opinions by selecting the individual principles on which most authors agree and add additional principles, which should be applied during an offence proceeding in my opinion. On the basis of these selected principles I subsequently created a unique list of the key principles of an offence proceeding, e.g. principles that should certainly be applied during an offence proceeding. I added a brief commentary to the individual principles in order to explain the issue to the reader.
