[cze][eng] 1 Abstrakt Cílem této diplomové práce je komplexně shrnout účinnou právní úpravu oddlužení fyzických osob jako jednoho ze sanačních způsobů řešení úpadku dlužníka, tuto úpravu kriticky zhodnotit a pojednat o jejím možném vývoji do budoucna. V úvodních kapitolách této práce je definován pojem úpadku, zahájení insolvenčního řízení a jeho účinky. Následně je pojednáno o samotném oddlužení fyzických osob a pozornost je věnována celému oddlužovacímu řízení - od povolení oddlužení, přes jeho schválení a rozhodnutí o způsobu oddlužení, až po úspěšné skončení řízení a osvobození dlužníka od placení zbytku dluhů. V práci jsou rozebrány předpoklady přípustnosti oddlužení, definovány osoby, které jsou aktivně legitimovány k podání návrhu na povolení oddlužení, dále jsou zevrubně rozebrány možné formy oddlužení a v krátkosti jsou shrnuta specifika společného oddlužení manželů. Tato práce neponechala bez povšimnutí ani některé konkrétní problémy způsobené aplikací dosud nedostatečně upravených ustanovení insolvenčního zákona (i přes jeho četné novelizace) a jejich nejednotným výkladem ze strany insolvenčních soudů. Tato diplomová práce reflektuje prodlužnický vývoj institutu oddlužení v českém insolvenčním právu a upozorňuje na legislativní změny, které byly provedeny novelou zák. č. 294/2013 Sb. účinnou od 01. 01. 2014...1 Abstract The main aim of this master thesis is to summarise legislation in force concerning the debt discharge of natural persons as one of the methods of resolving bankruptcy, to appraise this legislation and to discuss its possible future development. In introductory chapters of the thesis, the author defines the concept of bankruptcy, initiation of insolvency proceedings and its effects. Subsequently, thesis deals with a discharge of natural persons and concentrates on discharge proceedings as a whole - from a discharge permission and approval, decision concerning the mode of discharge, to successful termination of discharge proceedings where the debtor is discharged, free of debt. Thesis analyses the prerequisites of discharge permissibility, defines subjects actively legitimated to file a discharge application and furthermore, it lists possible forms of discharge and summarise the particularities of joint discharge of spouses. Equally, this thesis describes the specific legal issues caused by the application of provisions of the Insolvency Act which have not been sufficiently adapted yet and by the lack of their uniform judicial interpretation.
