[cze][eng] Lobbing: ekonomické a právní aspekty Abstrakt Cílem této práce je vymezení lobbingu jako legitimní součásti demokratických procesů a návrh doporučení pro regulaci lobbingu v České republice. K dosažení tohoto cíle byla provedena analýza regulace lobbingu v USA, EU a sousedních státech. Zaměření je také na analýzu pokusů regulace v České republice s ohledem na vliv nevládních organizací. První kapitola se věnuje komparaci rozličných definicí lobbingu, které ukazují hlavní aspekty a podobnosti napříč definicemi. Obsahuje nepostradatelné definice lobbingu jako činnosti a jeho hlavních aktérů - lobbistů a adresátů lobbingu. Druhá kapitola se věnuje srovnání zákonné regulace a samoregulace s vyhodnocením jejich kladů a záporů. Rozdíl mezi lobbingem a korupcí jako často zaměňovanými pojmy je ohniskem třetí kapitoly. Následující tři kapitoly se věnují historické a právní analýze lobbingu na území Spojených států amerických, Evropské unie a sousedních států. Regulace lobbingu v USA v jeho institucionální podobě si prošla nejdelší historií. Regulace lobbingu v EU je ukázkou odlišné terminologie, která se používá při komunikaci s Evropským parlamentem a Evropskou Komisí. Sousední státy byly vybrány vzhledem ke kulturní blízkosti uvnitř regionu. Sedmá kapitola se věnuje analýze pokusů regulace lobbingu v České...Lobbying: economic and legal aspects Abstract The aim of this thesis is to determine lobbying as a legitimate part of democratic processes and to propose recommendations for the regulation of lobbying in the Czech Republic. To achieve this aim, an analysis of the regulation of lobbying in the USA, EU and neighbour states, is conducted. Emphasis is also put on the analysis of regulation attempts in the Czech Republic with regard to influence of Non-Governmental Organizations. The first chapter is dedicated to a comparison of various lobbying definitions which are presenting main features and similarities across definitions. Among the main features are definitions of lobbying activity, lobbyist and public officials. The second chapter is dedicated to a comparison of government regulation and self-regulation, and the positives and negatives are assessed. The difference between lobbying and corruption is the main focus of the third chapter. Next three chapters are dedicated to the historical and legal analysis of lobbying in the USA, EU and neighbour states. The regulation of lobbying in the USA has the longest history.
