Účast znalců a odborníků ve vyšetřování Abstrakt Diplomová práce na téma účast znalců a odborníků ve vyšetřování je kompilačním dílem, ve kterém byla využita metoda obsahové analýzy knižních, internetových a časopiseckých pramenů. Po krátkém uvedení do historie znalecké činnosti se zabývá zákonnou úpravou znalce a znalecké činnosti zejména pro oblast trestního řízení. Za využití odborné literatury, platné legislativy a vlastních zkušeností z přípravného řízení autorka vymezila základní instituty pro využívání odborníků ve vyšetřování. Byly tak blíže popsány pojmy jako odborník, konzultant orgánu činného v trestním řízení, znalec, znalecký ústav, znalecký posudek a odborné vyjádření. Je zde nastíněna možnost využití škály expertízní činnosti při práci kriminalistů. S odkazem na svou dosavadní praxi autorka uvedla nejčastěji využívané formy spolupráce s odborníky a současné trendy uplatňování odborných vyjádření v praxi. Vedle toho je v práci pojednáno o některých způsobech zajišťování a vyhodnocování kriminalisticky relevantních stop. Z procesního hlediska je popsán výběr a ustanovení znalce, struktura znaleckého posudku a odborného vyjádření. Důležitou součástí práce je i hodnocení odborných vyjádření a znaleckých posudků. Zde se autorka snažila zdůraznit vzájemné vazby a formy spolupráce orgánů činných v... Participation of experts and professionals in investigations Abstract The topic of the thesis is the involvement of experts and professionals in criminal investigations. It is a compilation work, using the content analysis of books, internet, and magazine sources. Following a brief background on the history of experts' activities, it focuses on the legal regulation of experts / expert witnesses and their conduct, in particular in criminal proceedings. Making use of professional literature, applicable legislation, and her own experience in pre-trial proceedings, the author defines the basic concepts of using experts in criminal investigations. Terms such as a professional, consultant to a body involved in criminal proceedings, expert witness, expert institute, expert opinion, and professional opinion are described in detail. The thesis then outlines the options of using various expert activities in investigators' work. Referring to her practical experience, the author presents the most frequently used forms of cooperation with experts, and current trends in applying professional opinions in pre- trial proceedings.
