Diplomová práce je věnována problematice ochrany osobnosti. V práci jsou představeny národní, evropské a mezinárodní právní prameny, kterými je ochrana osobnosti regulovaná. Hlavním předpisem, ze kterého práce vychází, je občanský zákoník. Potřebu chránit osobnostní práva však nereflektuje pouze právo občanské, ale i jiná právní odvětví, e. g., trestní právo s institutem pomluvy nebo mediální právo s ustanovením o právu na odpověď. Z rozsáhlého tématu ochrany osobnosti je práce zaměřena na užší oblast, i. e., na ochranu osobnosti v mediálním prostředí. Vedle analýzy osobnostních práv (včetně práva na jméno), definic pojmů a oprávněných i neoprávněných zásahů je v práci poskytnut prostor i pro otázku ochrany osob veřejného zájmu a porovnání ochrany poskytované občanským zákoníkem fyzickým osobám a osobám právnickým. S ochranou osobnosti osob veřejného zájmu je často spojena kolize základních práv přesněji střet práva na ochranu osobnosti se svobodou slova. V práci je nastíněno, jak soudy přistupují k řešení tohoto střetu a k jakým kritériím je v konkrétních případech přihlíženo. Přínos práce je spatřován také ve vytvoření přehledu testů, které se využívají pro řešení střetu ústavou garantovaných práv. This master thesis is focused on the topic of protection of personality rights with respect to media. The thesis presents national, European and international sources of law related to the protection of personality rights. The fundamental basis of the thesis is the Civil Code. However, the regulation of the personality rights protection is not limited to the Civil Code. Instead, it is entangled in numerous other law disciplines, e.g. the Criminal Law and the institute of defamation or the Media Law and the regulation of the right of reply. Out of the broad topic of the protection of personality rights, only a narrow section, i.e. the protection of the personality laws with respect to media, is taken into account. Besides an analysis of personality rights, an extended nomenclature description and a discussion of rightful and wrongful derogations of personality rights, a notable attention is also given to the problematics of public figures and to the comparison of the personality rights protection provided by the Civil Code to the individuals and to the legal entities.
