Problematika výjimečného trestu Abstrakt V této diplomové práci se zabývám současnou právní úpravou výjimečného trestu odnětí svobody a jeho dopady na odsouzené. Výjimečný trest odnětí svobody představuje nejpřísnější možný postih trestné činnosti v České republice, zasahuje do mnoha oblastí základních lidských práv a výrazně je omezuje, z tohoto důvodu je dle mého názoru nezbytné, aby se této problematice věnovala dostatečná pozornost. Práce je členěna do osmi kapitol, přičemž mimo poslední je každá kapitola tematicky dělena na podkapitoly. Na úvod se zabývám samotným pojmem trestu a filozofickými východisky účelu trestání. Druhá kapitola je věnována historickému vývoji trestání v českých zemích, zejména se zaměřením na nejpřísnější tresty, tedy trest smrti, trest doživotního odnětí svobody a nejdelší možné tresty žaláře. Ve třetí kapitole jsou zmíněny nejvýznamnější mezinárodní dokumenty, které významnou měrou ovlivnily naši vnitrostátní právní úpravu, ať už v oblasti ukládání trestů, tak v oblasti zajištění vhodných podmínek ve věznicích. Stěžejní částí práce jsou kapitoly čtyři a pět, které se zabývají platnou právní úpravou. Kapitola čtyři je věnována otázkám ukládání výjimečného trestu, odlišnostmi průběhu trestního řízení, možnostmi podmíněného propuštění nebo otázkou milosti prezidenta. Kapitola pět... Problematics of extraordinary punishment Abstract In this diploma thesis I deal with the current legal regulation of the extraordinary punishment and its impact on prisoners. Extraordinary pinoshment is the strictest possible punishment of crime in the Czech Republic, that involves many areas of basic human rights and it significantly restricts them, for that reason, in my point of view, is necessary, that this issue has sufficient attention. The thesis is divided into eight chapters, except the last chapter, all of them are thematically divided into subchapters. At the beginning, I deal with the concept of punishment and philosophical grounds for punishment. The second chapter is devoted to the historical development of punishment in the Czech Republic, mainly focusing on the most severe punishment, as the death penalty, life imprisonment and the longest possible prison sentences. The third chapter discussed the most important international documents that significantly influenced our national legislation, both in sentencing and in providing appropriate conditions in prisons. The core parts of the thesis are chapters four and five, which deal with valid legislation.
