[cze][eng] Otázka přístupu k nenarozenému lidskému plodu je řešena již od pradávna. Při diskuzích se objevují otázky nejen morální a etické, ale také právní. V této souvislosti lze najít celou řadu protichůdných názorů daných jak výchovou, náboženským přesvědčením, tak například morálkou. Nalézt celospolečenský konsenzus je těžké. S možnostmi moderní doby vyvstávají nové otázky spojené se zásahy do reprodukce, výzkumem embryonálních buněk, ale také s problematikou umělého přerušení těhotenství, jež je dnes chápáno jako právo ženy a jejich počet ve světě se pohybuje ročně kolem 44 milionů. Díky těmto problémům vzniká aktuální potřeba společenské diskuze na téma postavení embrya, odkdy jej lze považovat za člověka. V teoretické části bakalářské práce je řešen právní pohled na postavení lidského embrya a jeho ukotvení v našem právním řádu. Listina základních práv a svobod, která je součástí Ústavy ČR stanoví, že každý má právo na život a že lidský život je hoden ochrany již před narozením. Není a ani nemůže být právem jasně stanoveno, kdy vzniká lidský život. Hledání na odpověď na tuto otázku přísluší spíš morálním a etickým principům. Práce předkládá různé pohledy na to, zda zygota, tedy oplodněné vajíčko je nebo není lidskou osobou. Zabývá se množstvím protichůdných argumentů, od kdy lze datovat vznik lidského života. Odpověď na tyto otázky není jasná a nelze dojít jednoznačné shody. Dále se bakalářská práce zabývá etickými dilematy spojenými s umělým přerušením těhotenství a zásahy do reprodukce, ale též se dotýká i problematiky klonování. Výzkum této bakalářské práce je zaměřen na právní a etický status embrya, především na odpovědi na otázky kdy vzniká lidský život a s tím spojená problematika interrupcí (potratů). Tato práce nedává jasnou odpověď na otázku od kdy datovat vznik života, ale představuje názory vybraného vzorku mladé generace, ve věkovém rozpětí 18-30 let. Hlavním cílem výzkumu bylo zjistit, jak se na dosud nenarozené dítě dívají mladí lidé v České republice, od kdy vnímají, že začíná lidský život, kdo rozhoduje o životě nenarozeného jedince a jak se staví k otázce umělého přerušení těhotenství. Podpůrným cílem výzkumné práce bylo posoudit, zda se názory mladých lidí liší podle toho, zda se jedná o muže nebo ženu, zda je to mladý člověk do 24 let nebo člověk 25 letý a starší, zda je věřící či zda už má vlastní dítě nebo děti. Výzkumná část práce proběhla formou kvantitavního výzkumu, použito bylo dotazníkové šetření. Výběrový soubor byl tvořen 250 respondenty, především formou dotazníku na webu, menší část tištěné dotazníky. Pro tuto práci byla jako mladá generace zvolena věková skupina 18-30 let. Dotazník obsahoval sedm zjišťovacích otázek a čtyři otázky rozlišovací. Ve výzkumné části bylo pracováno s daty, které byly získány z dotazníkového šetření. První hypotéza, že více jak 50% respondentů/tek se domnívá, že lidský život začíná početím, nebyla potvrzena. Pro počátek života při početí se vyslovilo pouze 30% respondentů/tek. V případě druhé hypotézy se pro možnost "schvaluji umělé přerušení těhotenství ze zdravotních důvodů" vyslovilo 90% respondentů/tek a druhá hypotéza se tedy potvrdila. Třetí hypotézu se nepodařilo potvrdit. V diskuzi pak byly porovnány zjištěné výsledky s názory autorů, ze kterých bylo čerpáno v teoretické části práce. V závěru se práce věnuje celkovému shrnutí výsledků. Na otázku, kdy vzniká život, je nemožné najít jednotnou správnou odpověď. Vždy záleží na subjektivním pohledu každého člověka. Od kdy datovat vznik života bude stále více aktuálním a palčivým tématem, především díky pokroku vědy a technologií. Měli bychom si uvědomit všechna možná rizika, zamyslet se nad tím, kdo má právo zasahovat do podstaty života, kam až nechat vědu zajít. Tato bakalářská práce nepřekládá jediný jasný názor, ale může poskytnout fakta a náměty k zamyšlení, aby si každý mohl vytvořit svůj vlastní postoj k danému tématu. There has been the question of the approach to the unborn human foetus which has been dealt with for many years. The moral, ethic or legal questions appear during the discussions. In this context we could find many different opinions related to the upbringing, religion or morality. It is hard to find any general agreement. Nowadays there are new questions connected to the intervention of reproduction, the research of embryo cells or the issues of abortion, which is perceived as the women's right. There are about 44 billions of abortions these days. According to these problems there is the need of the social discussion about the understanding of embryo and when we can consider it as a human being. The theoretical part of my bachelor thesis deals with the legal point of view to the role of human embryo and its securing in our legal system. The Charter of Fundamental Rights and Freedoms, which is a part of the Constitution of the Czech Republic, determines that everybody has the right for living as well as the human life should be protected before the delivery. There is not and there also cannot be determined clearly when the human life begins. The answer for this question is connected to the moral and ethic principles. My thesis deals with the different points of view to this question, if the fertilized ovum is or is not the human. There are also many various arguments about when we can consider the genesis of human life. The answer for these questions is not clear and we cannot find out the definite concordance. The other part of my thesis deals with ethic dilemmas connected to the abortion and the intervention to the reproduction as well as the problems of cloning. The practical part of my bachelor's thesis deals with the legal and ethic status of embryo mainly to the questions of the genesis of human life and the problems of the abortion. This thesis do not provide the clear answer to the question since when we can date the genesis of the life but it represents the opinions of the young generation (18 - 30 years old). The main aim of the research was to find out the point of view of the young people in the Czech Republic. There were questions about the reaction to the unborn child, the genesis of human life, who decides about the life of the unborn child and the abortion. I compare the questions according to the sex, ages, religion and parenthood. The practical part was made by the quantitative research questionnaires. It consists of 250 respondents who were asked by the on-line or printed questionnaire. It was chosen the young generation between 18 - 30 years old. The questionnaire contains seven fact-finding questions and four distinctive ones. It was worked with the data which were acquired from the questionnaire. The first hypothesis, 50% of respondents believe that the human life begins with the conception, was not confirmed. There were only 30% of respondents who believe that question. The second hypothesis, the approval of abortion, was confirmed because there were 90% respondents who agreed. The third hypothesis could not be confirmed. In the discussion the results were compared with the opinions of the authors from the theoretical part of my thesis. The end of my thesis deals with the general results. We cannot find the right answer to the question of the beginning of human life. Every person has a subjective point of view. We should realize every possible risks and think about who has the right to intervene to the substance of human life and how far can technology goes. This bachelor's thesis do not have the clear opinion but it provides the facts and the suggestion for thinking for creating its own attitude to these questions.
