Uznání a výkon cizích rozhodčích nálezů v ČR a USA Abstrakt Předmětná rigorózní práce pojednává o tématu uznání a výkonu cizích rozhodčích nálezů, přičemž je tato problematika ilustrována na právní úpravě České republiky a Spojených států amerických. Cílem práce je ozřejmit téma uznání a výkonu cizích rozhodčích nálezů v obou státech, vymezit jejich právní úpravu, a poté poukázat na jejich společné a odlišné znaky v oblasti důvodů pro odepření uznání a výkonu cizích rozhodčích nálezů a v samotném procesu tohoto uznání. Kromě úvodu a závěru je předmětná rigorózní práce členěna do pěti samostatných kapitol. V první kapitole se autor věnuje vymezení rozhodčího řízení v systému alternativního řešení sporů, přičemž rovněž uvádí výhody a nevýhody rozhodčího řízení oproti řízení před obecnými soudy. V další části pak autor vymezuje pojem rozhodčího nálezu, resp. cizího rozhodčího nálezu, a to ve světle všech dotčených právních předpisů. Druhá kapitola se věnuje Úmluvě o uznání a výkonu cizích rozhodčích nálezů. V této kapitole autor rozebírá jednotlivá ustanovení Úmluvy s přihlédnutím k jejich věcnému rozsahu. Tato ustanovení pak autor interpretuje mimo jiné i za pomoci obsáhlé judikatury národních soudů, přičemž v několika případech k těmto rozhodnutím přidává i svůj kritický názor. Recognition and Enforcement of foreign arbitral awards in the Czech Republic and in the United States of America Abstract This rigorous thesis deals with the topic of recognition and enforcement of foreign arbitral awards, and the issues are illustrated by the legal regulations of the Czech Republic and the United States of America. The aim of the thesis is to clarify the issue of recognition and enforcement of foreign arbitral awards in both countries, to define their legal regulations and to point out their common and different features in the field of grounds for refusal to recognize and enforce foreign arbitral awards and in the process of such recognition. Apart from the introduction and the conclusion, the present rigorous thesis is divided into five separate chapters. The first chapter deals with the definition of arbitration in the ADR system and points out the advantages and disadvantages of the arbitration as compared to the proceedings at state courts. The author defines the concept of an arbitral award or a foreign arbitral award within all the relevant regulations in the next part. The second chapter deals with the Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
