Tématem této práce jsou vybrané otázky trestného činu nebezpečného pronásledování podle § 354 trestního zákoníku. Trestný čin nebezpečného pronásledování postihuje celospolečensky škodlivý jev známý pod anglickým názvem "stalking", jež představuje široké spektrum často předem nepředvídatelných variant jednání. V této práci jsem si dala za cíl zanalyzovat skutkovou podstatu trestného činu nebezpečného pronásledování a zasadit ji do širších souvislostí. Zároveň je cílem práce poskytnout návrhy de lege ferenda na zlepšení stávající právní úpravy, a to za prvé, důkladným rozborem této skutkové podstaty, za druhé, náhledem do aplikační praxe, a za třetí, komparací se zahraničními právními úpravami. Předkládaná diplomová práce je členěna do čtyř hlavních celků, jež jsou děleny na jednotlivé kapitoly a podkapitoly. Tyto celky na sebe logicky navazují a dávají čtenáři možnost postupně proniknout do celé materie práce. Postupuji od obecnějšího výkladu a popisu problematiky stalkingu k analýze skutkové podstaty trestného činu nebezpečného pronásledování. Celá práce je pro její lepší ilustraci a pochopení protknuta příklady z praxe. V úvodní části je popsán fenomén stalkingu jako takový, včetně jeho nejběžnějších forem, jakými jsou ex-partner stalking, cyberstalking a celebrity-stalking. Zároveň se zde... This Thesis focuses on the topic of selected issues of the crime of Stalking according to Section 354 of the Criminal Code. The offence of Stalking affects the socially harmful phenomenon known under its English name "stalking", which represents a wide range of often unpredictable forms of behavior. In this Thesis, I aimed to analyze the constituent elements of the criminal offence of Stalking and to place it in a broader context. At the same time, the aim of the work is to provide de lege ferenda proposals for improving existing legislation, firstly by thoroughly analyzing the constituent elements of the offence, secondly, by looking at practical use of the provision of the law, and thirdly, by comparing it with foreign legal regulations. This Diploma Thesis is divided into four main sections, which are further divided into individual chapters and subchapters. These sections follow consecutively logically and give the reader the opportunity to gradually penetrate into the whole matter. I have proceeded from a more general explanations and descriptions of the issue of stalking to the detailed analysis of the crime of Stalking.
