Cílem této práce je osvětlit některé problémy cizineckého práva, konkrétně zdvojení úpravy maření správního rozhodnutí cizincem, tj. zda se v takovém případě má postupovat dle zákona o pobytu cizinců či dle trestního zákoníku, a tím určení, která z těchto úprav má přednost. V této práci jsou proto oba instituty podrobně rozebrány včetně geneze jejich vzniku a případných proměn v rámci novelizací, stejně jako jejich dopadů na cizince. Dále byly rozebrány příbuzné instituty, kterým je např. rozhodnutí o povinnosti opustit území, anebo zajištění a zadržení cizince, které mohou ovlivnit rozhodování o využití té které právní úpravy. V této práci byla analyzována platná a účinná právní úprava ČR, jakož i judikatura, a to nejen českých soudů, ale taktéž soudů mezinárodních, kterými jsou Soudní dvůr Evropské unie event. Evropský soud pro lidská práva. Provedenou podrobnou rešerší za využití statistik od pověřených státních orgánů, jakož i ze sesbírané sbírky případů, jsme zjistili, že variabilita využití obou institutů, potažmo institutů dalších či náhradních, odpovídá tomu, co by bylo možné označit za "náhodný výběr", tj. že v našem právním řádu pro rozhodování o tom, zda bude v případě maření správního rozhodnutí postupováno dle zákona o pobytu cizinců nebo dle trestního zákoníku, není systémově... The thwart of the execution of decision of administrative expulsion The aim of this paper is to elucidate some problems of foreign law, specifically the duplication of the regulation of the thwart of the administrative decision, i.e. whether to proceed in accordance with the Act on the Residence of Foreign Nationals in the Czech Republic or the Criminal Code and thus determine which of these adjustments takes precedence. In this paper, therefore, the two institutions are thoroughly analyzed, including the genesis of their origins and possible changes in the amendments, as well as their impact on foreigners. In addition, related institutions were analyzed, such as decisions on the obligation to leave the territory, or the retention and detention of an foreigner, which may influence decision making on the use of such legislation. In this paper the valid and effective legislation of the Czech Republic, as well as the case law, not only of the Czech courts, but also of the international courts, such as the Court of Justice of the European Union or the European Court of Human Rights, have been analyzed.
