Disertační práce se podrobně zaobírá trestným činem legalizace výnosů z trestné činnosti (trestný čin praní peněz), jak je upraven v současném českém trestním kodexu. Jádrem práce je analýza nejdůležitějších prvků trestného činu praní peněz, kterými jsou právní objekty, objektivní stránka, subjektivní stránka a subjekt trestného činu. V rámci této analýzy jsou rozebrány všechny důležité a doktrinálně sporné otázky týkající se tohoto trestného činu, například složitý problém právních objektů trestného činu praní peněz nebo otázka odpovědnosti za tzv. samopraní. Detailní rozbor znaků trestného činu praní peněz přitom vychází z pojednání o nejdůležitějších fenomenologických aspektech praní peněz (zejména o důvodech praní peněz, původu praní peněz a charakteru procesu praní peněz včetně způsobů realizace praní peněz) a z pojednání o historickém vývoji skutkové podstaty trestného činu praní peněz v tuzemském právu. Kromě rozboru problematiky viny obsahuje práce i poměrně podrobné pojednání o problematice trestání praní peněz. Speciální kapitola je pak věnována trestní odpovědnosti právnických osob, kde jsou kromě některých obecných otázek (např. povaha trestní odpovědnosti právnických osob) rozebrány i znaky trestného činu praní peněz u právnických osob. The dissertation thesis thoroughly examines the crime of legalization of proceeds of criminal activities (the crime of money laundering) as it is stipulated in the contemporary Czech Criminal Code. The crux of the thesis is an analysis of the most significant elements of the crime of money laundering that are legal objects (general values protected by criminal law), actus reus (physical elements of a crime), mens rea (mental elements of a crime) and offender (person who commits a crime). Within the framework of that analysis, all of the important and disputed questions relating to this crime are examined, e.g. a complex problem of legal objects of the crime of money laundering or a question of liability for so-called self-money laundering. The detailed analysis of the elements of the crime of money laundering is based on a research into the most important phenomenological aspects of money laundering (chiefly the grounds for money laundering, origin of money laundering and nature of the process of money laundering, including the means of realization of money laundering) and a research into the historical development of the elements of the crime of money laundering in the Czech legal order.
