[cze][eng] Svěřenské fondy v mezinárodním právu soukromém Práce se zkoumá institut trustů a svěřenských fondů vytvořených na základě jednání zakladatele (express trusts) v mezinárodním právu soukromém. Cílem je srovnání právní úpravy zákona č. 89/2012 Sb., občanský zákoník, a zákona č. 91/2012 Sb., o mezinárodním právu soukromém s úpravou Haagské úmluvy o právu použitelném pro trusty a jejich uznávání. Práce se skládá ze třech hlavních kapitol, úvodu a závěru. Druhá kapitola se zaobírá historickým vývojem a původem starořímských fideikomisů, common law trustů a rodinných fideikomisů. Třetí kapitola blíže analyzuje pojem a charakteristiku trustů a svěřenských fondů v České republice, reflektuje navrhované novelizace, předestírá chápání pojmu trustů z pohledu Evropské unie a Evropského sdružení volného obchodu. V neposlední řadě rozebírá charakteristiku trusů ve smyslu Haagské úmluvě o právu použitelném pro trusty a jejich uznávání. Čtvrtá kapitola se zaměřuje na způsoby určení rozhodného práva použitelného pro trusts a jejich uznávání na národní, evropské a mezinárodní úrovni. Práce reflekture úpravu zákona č. 91/2012 Sb., o mezinárodním právu soukromém, zmíněné Haagské úmluvy a relevantních právních předpisů Evropské unie se speciálním zřetelem na Nařízení Evropského parlamentu a rady (EU) č. 650/2012 ze dne...Trusts in Private International Law The thesis is focused on comprehension of trusts and Czech trust-like sverenske fondy created voluntarily by the settlors (express trusts) in private international law. The aim is to provide a comparative study of the provisions of the Czech Act No 89/2012 Coll., Civil Code, Act No 91/2012 Coll., on Private International Law, and the Hague Convention of the Law Applicable to Trusts and their Recognition. The thesis is subdivided into three main chapters, introduction and summary. The second chapter reflects on historical development of Roman fideicomisses, common law trusts, as well as continental family fideisomisses. The third chapter slocer analyses the notion and characteristics of trusts and sverenske fondy in the Czech Republic, provides the reasoning behind the understanding of express trusts from the perspective of the European Union and the European Free Trade Association. The thesis further reflects on the characteristics and understanding the trusts in the provisions of the Hague Convention of the Law Applicable to Trusts and their Recognition. Fourth chapter is dealing with the conflict law provisions applicable with respect to trusts and their recognition in national, European and international level.
