Návrh Evropské komise ve věci reformy mechanismu řešení investičních sporů: komparativní analýza V listopadu 2015 předložila Evropská komise v rámci jednání o investiční kapitole dohody TTIP delegátům USA k jednání text, který se výrazně liší od klasických modelů ISDS. Tento reformní návrh Komise vychází ze současné vlny kritiky, která označuje investiční arbitráž za nelegitimní a požaduje její výraznou reformu či dokonce úplné odstranění z textu návrhu dohody TTIP. Komise k vypracování návrhu přikročila poté, co se veřejné konzultace vypsané v odpovědi na kritiku ISDS setkaly s výrazným zájmem veřejnosti. Tato práce si klade za cíl analyzovat návrh Komise a stanovit, zda Komise v jednáních o dohodě TTIP předložila kvalitní návrh, který je schopen nahradit dosavadní tradiční koncepci ISDS. Dále je cílem této práce zkoumat, zda mezi návrhem Komise a tradiční koncepcí ISDS existují výrazné či spíše drobnější rozdíly, a zda by v některých aspektech mohla Komise zvolit lepší řešení. Po úvodní kapitole věnované výše zmíněné kritice legitimity investiční arbitráže a výsledkům veřejné konzultace se práce ve druhé kapitole věnuje analýze fungování návrhu Komise. Pozornost je věnována zejména procesním aspektům fungování řízení před stálým investičním soudem, jehož založení Komise navrhuje. Jako hlavní... European Commission's Reform Proposal Concerning The Investment Dispute Settlement Mechanism: Comparative Analysis In November 2015, during negotiations with the USA about the investment chapter of TTIP, the European Commission presented US delegates with a text which significantly differs from the traditional model of ISDS. Commission's reform proposal is a reaction to the current criticism directed towards the legitimacy of investment arbitration and to the demands for its thorough reform or even removal from the TTIP draft text. The Commission introduced the proposal after the public consultation opened in connection with the criticism of ISDS attracted significant public interest. This thesis aims to analyze the Commission's proposal and determine whether the Commission has introduced a sound proposal which would be capable of replacing the traditional concept of ISDS. The thesis further examines whether there are smaller or larger differences between the Commission's proposal and traditional ISDS and whether the Commission could have taken a different approach to some issues. After the first chapter dedicated to the criticism of investment arbitration and the results of the public consultation, the thesis analyses the Commission's proposal.
