Tato práce vymezuje právo módního průmyslu jako zvláštní horizontální odvětví práva, které se vztahuje k ochraně designu, materiálů, postupu a technologii výroby, tvaru a liniím, barvě, vzhledu povrchové úpravy, logu, názvu výrobku, ale i k licencování nebo uplatňování a vymáhání práv k výrobku obchodníky a obchodními řetězci, výrobci, designéry a módními návrháři na poli módního průmyslu. Práce popisuje vznik a vývoj práva módního průmyslu ve Spojených státech amerických a podrobně se zabývá dosavadním vývojem tohoto oboru také v České republice. Práce vymezuje pojem módní design, jeho charakteristické znaky a zvláštní vlastnosti oproti jiným druhům designu. V práci jsou podrobně analyzovány jednotlivé způsoby ochrany módního designu, s důrazem na známkoprávní ochranu, které mohou módní návrháři a výrobci módního zboží využívat v souladu s právní úpravou v České republice. Kromě teoretické analýzy je v práci představena rozhodovací praxe soudů, zejména v oblasti právní ochrany módního designu. Postupně je rozebrána právní úprava a relevantní judikatura ve vztahu k ochraně autorskoprávní, ochranným známkám, průmyslovým vzorům, ochrana nekalosoutěžní a také je nastíněn v České republice nepříliš známý institut trade dress. Prostor je věnován také souběhu ochrany prostřednictvím autorskoprávní... This thesis defines fashion law as a specific horizontal legal field that relates to the protection of design, materials, manufacturing processes, technology, shapes, lines, colours, finishing and labelling, trademark infringement and copyright protection. Moreover, it deals with crucial topics in the field of fashion law including licensing and enforcement of rights to the products available to retailers, manufactures, and fashion designers. In addition, the thesis studies the establishment and development of fashion law abroad, particularly in the United States of America, as well as in the Czech Republic. In this thesis, the definition of fashion design includes its features and unique remarks in comparison to other types of design. Further, the thesis thoroughly examines and analyses the protection of fashion design available to retailers, fashion designers and manufactures under Czech law, especially trademark protection, copyright protection, competition law and trade dress protection. It studies various sources of law, including case law, statutes, international treaties and soft law that relate to the protection given by the Czech and other legal systems.
