[cze][eng] Shrnutí Postavení panovníka podle rakouských ústav Účelem diplomové práce je analyzovat postavení, které náleželo hlavě habsburské monarchie podle rakouských ústav z druhé poloviny 19. století. Změny, které způsobila revoluční léta 1848-1849 v ústavním systému monarchie se projevily i na úrovni hlavy státu. Císař už neměl být jediným reprezentantem státní moci, ale měl se na ní podílet společně s parlamentem a vládou. Při zkoumání těchto změn, je nutné od sebe odlišovat formální postavení císaře, jaké mu podle ústav náleželo a postavení faktické. Po faktické stránce si totiž císař udržel až do rozpadu monarchie na výkon státní moci značný vliv. V práci jsou zkoumány tyto ústavy: Pillersdorfova (dubnová) ústava z roku 1848, návrh kroměřížské ústavy z roku 1849, Stadionova (březnová) ústava z roku 1849, Schmerlingova (únorová) ústava z roku 1861 a Beustova (prosincová) ústava z roku 1867. Práce je rozdělena do šesti kapitol. V první kapitole je popisován ústavní a politický vývoj habsburské monarchie od revoluce v roce 1848 až do vydání prosincové ústavy v roce 1867 a jsou zde charakterizovány jednotlivé ústavy. Druhá kapitola se zabývá systematikou právní úpravy hlavy státu v jednotlivých ústavách. Kromě toho porovnává ústavní charakteristiky císařovy osoby podle těchto ústav včetně otázky nástupnictví. Ve...Resume Status of the emperor according to the Austrian constitutions The purpose of this thesis is to analyze the position which belonged to the head of the Habsburg Monarchy according to the Austrian Constitutions from the second half of the 19th century. The revolutionary years 1848-1849 caused changes in the constitutional system of the monarchy. These changes were also reflected at the level of head of state. The emperor was no longer to be sole representative of state power, but he had to participate in it together with the parliament and the government. When examining these changes, it is necessary to differentiate the formal position of Emperor, which belonged to him under the Constitutions and his factual position. Realistically, the emperor maintained until the collapse of the monarchy considerable influence on the exercise of state power. The work explores the following constitutions: Pillersdorf (April) constitution of 1848, Kremsier constitution of 1849, Stadion (March) constitution of 1849, Schmerling (February) constitution of 1861 and Beust (December) constitution of 1867.
