Resumé Název práce: Zdaňování provozovatelů hazardních her Cílem této práce je představit čtenáři systém zdanění provozovatelů hazardních her platný v současné podobě i rovněž i navrhovanou úpravu zákona o hazardních hrách a zákona o dani za hazardních her. V úvodu první kapitoly je krátce pojednáno o společenských nákladech závislosti na hazardních hrách jako současného společenského problému a jeho možné řešení z pohledu práva. Další části kapitoly první postupně probírají evropskou úpravu veřejnoprávní regulace hazardních her, instituty zákona o loteriích a jiných podobných hrách jakožto základního předpisu práva hazardních her a jejich vztah k občanskému zákoníku. Následuje subkapitola právu obce regulovat na svém území prostřednictvím obecně závazných vyhlášek některé druhy hazardních her a posuzování této otázky Ústavním soudem. Poslední část první kapitoly obsahuje podrobnější analýzu navrhované úpravy zákona o hazardních hrách, včetně komparace některých institutů tohoto návrhu se stávající úpravou a jejich dílčího hodnocení. Druhá kapitola se zaměřuje na aktuální systém právní úpravy zdanění hazardních her, rozebírá druhy finančně-právních povinností uložených provozovatelům a nepomíjí ani historickou úpravu. Cílem této kapitoly je připravit čtenáře na porovnání současné a navrhované úpravy. Ve... Title: Taxation of gambling operators The aim of this thesis is to introduce the system of the taxation of gambling operators currently applicable in the Czech republic together with the proposed bill on the gambling and the proposed bill on the taxation of gambling. At the beginning of the first chapter the thesis discusses the social costs of gambling addiction being a current social issue and its possible solutions from the viewpoint of law. Further parts of the chapter subsequently deal with the european legislation on public regulation of gambling, institutes of the Act on lotteries on other similar games as the primary piece of gambling legislation and their relation to the Civil Code. The subchapter regarding the right of municipalities to regulate some of the types of gambling by the means of municipal ordinances follows, including the question of an assesment of the said issue by the Constitutional Court. The last part of the first chapter contains detailed analysis of the proposed bill on the gambling, including comparation of some of its institutes with the current legislation and their partial assesment.
