Diplomová práce se zabývá odškodňováním nároků poškozených z pojištění odpovědnosti za újmu způsobenou provozem vozidla a zejména pak jednotlivými nároky poškozených, plynoucí z pojištění odpovědnosti za újmu způsobenou provozem vozidla, kde se snaží porovnat právní úpravu účinnou do 31. prosince 2013 s právní úpravou účinnou od 1. ledna 2014 a poukázat na nejdůležitější dopady zákona č. 89/2012 Sb., občanský zákoník, do oblasti odškodňování nároků poškozených vzniklých způsobením újmy na zdraví nebo usmrcením. Vzhledem k počtu dopravních nehod a vzhledem k tomu, že jde o problematiku, jíž se dotkla rekodifikace soukromého práva, jde o téma aktuální. Diplomová práce sestává z pěti kapitol. První kapitola pojednává o vývoji právní úpravy pojištění odpovědnosti za újmu způsobenou provozem vozidla na území České republiky. Druhá kapitola vymezuje základní pojmy a instituty související s odškodňováním nároků poškozených z pojištění odpovědnosti za újmu způsobenou provozem vozidla, jimiž jsou provoz, provozovatel, pojistitel, pojistník, pojištěný a poškozený, škoda a újma. Vedle toho se rovněž věnuje základním aspektům obecné odpovědnosti za škodu nebo jinou újmu a zvláštnímu typu odpovědnosti za škodu z provozu dopravních prostředků. Účelem třetí kapitoly je přiblížit čtenáři proces odškodňování nároků... The thesis deals with indemnification of claims of injured persons resulting from the insurance of liability for injury caused by operation of a vehicle and especially with individual claims of injured persons resulting from the insurance of liability for injury caused by operation of a vehicle, where it endeavours to compare legal regulation effective until 31th December 2013 with the legal regulation effective as of 1st January 2014 and it highlight the most important impacts of the Act No. 89/2012 Coll., Civil Code, in the area of indemnification of claims of injured persons originating due to infliction of physical injury or death. It is a very current topic considering the number of traffic accidents and due to the fact, that this is an issue was affected by the re-codification of the civil law. The thesis is composed of five chapters. Chapter one discusses development of legal regulation of the insurance of liability for injury caused by operation of a vehicle in the territory of the Czech Republic.
