[cze][eng] Resumé Primárním cílem této práce je zhodnotit, nakolik je pirátství na dnešním internetu rozšířené, kdo po právní stránce odpovídá za protiprávně sdílené soubory, jak se v současnosti v prostředí internetu s pirátstvím bojuje, jak lze subjekt, který odpovídá za porušování autorských práv na internetu identifikovat a jaký tomuto subjektu hrozí za takové konání postih. Zároveň práce nabízí úvahy, jakým způsobem by se mohly tyto oblasti do budoucna vyvíjet, a předkládá nástin legislativních změn, které by vedly k efektivnějšímu vymáhání autorského práva na internetu. Hlavním důvodem, proč jsem si vybral jako téma své diplomové práce "Internet a autorské právo - rozsah odpovědnosti jednotlivých subjektů (webhosting, poskytovatel připojení…) a způsoby ochrany proti pirátství (identifikace a postih piráta…)" je, že se jedná o dynamický obor práva, který se bude dále rozvíjet a jakožto rozvíjející se obor ho považuji za vhodný pro mou budoucí praxi. Navíc mám k prostředí IT systému blízko a zajímá mě jako takový. Taktéž se domnívám, že v rámci České republiky teprve dojde k "boomu" právní pří týkajících informačních technologií, což je vždy velká příležitost. Práce je rozdělena do devíti kapitol, přičemž každá kapitola se dělí do několika podkapitol, logicky na sebe navazujících. V úvodní kapitole čtenáři...The main goal of this thesis is to analyse to what extent piracy on today's Internet is spread; who is responsible for unlawfully shared files from the legal point of view; how it is fought against copyright infringement; how it is possible to identify a person being responsible for copyright infringement and with what kind of punishment the person is to be charged. Moreover, this thesis focuses on in what way the issues mentioned above could develop and presents an outline of legislation changes which would lead to more effective copyright enforcing. The main reason why I have chosen the topic "The Internet and copyright - the scope of responsibility of particular subjects (webhosting, the Internet provider…) and means of protection against piracy (the pirate identification and their punishment…)" is that I find this law field very dynamic and likely to develop further, which makes it appropriate for my future career. What is more, I am close and interested in IT myself. I also believe that the real "boom" of lawsuits has not come to the Czech Republic yet resulting in a good opportunity.
