Resumé Práce má za cíl popsat a zhodnotit aktuální stav právní úpravy osobnostních práv autora v právním řádu České republiky, a to zejména s ohledem na rekodifikaci soukromého práva. Osobnostní práva autora představují soubor základních právních institutů, od nichž se odvozuje struktura celé soustavy autorského práva. Detailním rozborem relevantních právních institutů souvisejících s osobnostními právy autora a tím, že přiblíží a zhodnotí základní elementy systému autorského práva má práce ambici přispět do dlouhodobé diskuse o vývoji a budoucnosti autorského práva. Postup byl systematicky zvolen tak, aby byly zmapovány všechny normativní vazby na osobnostní práva autora od mezinárodních úmluv a ústavního pořádku až po jednotlivé zákony. Práce se též snaží poukázat na některé méně zřejmé souvislosti osobnostních práva autora v jiných právních institutech, aby bylo dosaženo co nejkomplexnějšího obrazu aktuální podoby právní úpravy. Smyslem práce je též popsat na problematické či nejasné vztahy mezi právní úpravou podle autorského práva a podle NOZ, jako je například pojetí autorského díla z hlediska nového vymezení věci hmotné a nehmotné nebo společný základ osobnostních práv. Práce následně nabízí východiska pro budoucí uspořádání vztahů mezi autorským občanským právem na základě revidovaného základního... This thesis aims to describe and evaluate actual state of author's moral rights legislation in Czech republic especially with reference to civil law recodification. The author's moral rights represent a complex of basic juridical institutes, which is the whole copyright structure, derived from. The thesis has an ambition to contribute in a long term discussion about the future development of copyright by a relevant detail analysis, description and evaluation of basic copyright system elements related to author's moral rights. Selected method is based on systematically mapped normative linkage of author's moral rights within international treaties, constitutional law and unit acts. The thesis endeavours to point out some less obvious connections between author's moral rights and other juridical institutes to achieve as complex image of recent state of legislation as possible. Other purpose of this work is to analyse problematic or unclear relationships between copyright and new civil code legislation such as e.g. conception of a work protected by copyright in light of new definition of material and immaterial matter or shared principles of moral rights .
