[cze][eng] Resumé Tato práce je zaměřena na problematiku neohlášeného šetření na místě v soutěžním právu v českém a unijním kontextu. Jedná se o specifickou vyšetřovací pravomoc soutěžních orgánů provádět neohlášené místní šetření v obchodních prostorách soutěžitele a v jiných než obchodních prostorách. Účelem úpravy je možnost soutěžních orgánů si bez předchozí notifikace soutěžitele na místě opatřit informace z obchodních záznamů k prokázání jeho protisoutěžního jednání. Cílem této práce je poskytnout komplexní pohled na institut šetření na místě ve všech jeho aspektech, popsat vztah české a unijní úpravy místního šetření, poukázat na jednotlivé rozdíly v obou úpravách, upozornit na případné nedostatky při harmonizaci, podrobně popsat práva a povinnosti všech subjektů, kterých se místní šetření dotýká, a to celé ve světle rozhodovací praxe správních a soudních orgánů České republiky a Evropské unie. Práce je tvořena šesti kapitolami. První kapitola představuje úvod do dané problematiky a nastínění cílů, kterých má být v práci dosaženo. Ve druhé kapitole se stručně pojednává o základním vymezení právního odvětví, do kterého lze šetření na místě zařadit. Třetí kapitola vymezuje zasazení kompetencí soutěžních orgánů do komplexu unijní soutěžní úpravy včetně spolupráce v rámci Evropské soutěžní sítě. Čtvrtá kapitola...Unannounced on site inspections in competition The purpose of my thesis is to analyse unannounced on site inspections in the competition law with regards to the Czech and European Union legal system. The thesis is composed of six chapters. Chapter one is introductory and defines the aims of the thesis. Chapter Two briefly discusses the basic legal framework of this area of law. Chapter Three is subdivided into six subchapters and sets out the competence of competition authorities including the cooperation within the European Competition Network. Chapter Four consists of two parts and concentrates on problems resulting from specific administrative proceedings before the Office for the Protection of Competition. Chapter Five is composed of fourteen subchapters. Each of them deals with specific aspects and details of inspections in a broader perspective.
