[cze][eng] Resumé Diplomová práce na téma Mateřství a s ním spojená právní problematika se skládá ze tří obsáhlých částí, v nichž jsou rozebrány aktuální otázky mateřství z pohledů různých oborů práva. Toto téma je zajímavé tím, že ačkoli se na první pohled zdá velmi jednoduchým, skrývá v sobě řadu závažných právních problémů. První část nazvaná Ochrana mateřství v právu obecně je věnována základním pojmům rodinného práva, jimiž je rodina a rodičovství. Přestože nikde nenalezneme definice těchto pojmů, je konstatováno, že jde nepochybně o instituty hodné nejvyšší právní ochrany. V kapitole první jsou vysvětleny základy ochrany rodiny, rodičovství a mateřství postupně z pohledu právního řádu České republiky a z pohledu práva mezinárodního a evropského. Zvláštní pasáž je věnována také ochraně těhotných žen v českém právním řádu i v právu evropském a mezinárodním, která může být vnímána jako speciální projev ochrany rodiny. Zbývající kapitoly jsou zaměřeny na rodičovství, na význam jeho určení z pohledu právního a jeho dalekosáhlé důsledky. Je zdůrazněno, že mateřství i otcovství zakládají absolutní statusové právní vztahy, jichž se nelze jednostranně vzdát. Takové účinky je s to vyvolat jedině souhlas rodiče s osvojením dítěte. Despite the fact that the topic seems to be very simple, it contains many serious legal problems. Chapter One called General aspects of maternity protection in law has been dedicated to the basic terms of the family law, such as family and parenthood. Although it is not possible to find any definition of these terms, they certainly deserve the highest legal protection. The first part explains the basis of family, parenthood and maternity protection from the perspective of the legal order of the Czech Republic and from the perspective of international and European law. The next part deals with the protection of pregnant women in the national, international and European law, which may be regarded as a special expression of family protection. The following sections focus on parenthood, the importance of its determination in respect of law as well as on its far-reaching consequences. It is emphasized that motherhood and fatherhood constitute absolute-status legal relationships, which cannot be unilaterally given up.
