Dne 1. ledna 2014 nabyde účinnosti nový občanský zákoník. V něm jsou novým způsobem rozšířeny práva a povinnosti vztahující se k osobnostním právům člověka. Je rozšířen počet chráněných práv a dochází ke změně instrumentů jejich ochrany. S ohledem na tuto skutečnost dojde ke změně judikatury v předmětné oblasti. Nadále bude moci být aplikována judikatura týkající se osobnostních práv, jejich umístění v právním řádu a jejich významu, nicméně dojde k potlačení významu judikatury, která se dotýká nároků vyplývajících z porušení těchto osobnostních práv. Nově je vyřešena otázka promlčitelnosti nároků vyplývajících z porušení osobnostních práv. Spolu s účinností nového občanského zákoníku je plánovaná i změna příslušných procesních předpisů. Pro rozhodování o osobnostních právech a všech nároků z nich vyplývajících budou nově v prvním stupni příslušné Krajské soudy On 1 January 2014 will come into effect the new Civil Code. In it are a new way of extending the rights and obligations relating to personality rights of man. It expanded the number of protected rights and a change instruments for their protection. According to this fact, a change of case law in this area is neccesary as well. It will continue to be able to be applied to the case-law relating to personal rights, their position in the legal system and their significance, however, is to suppress the importance of case law, which concerns claims arising from violations of personal rights. The new issue is resolved lapse of claims arising from violations of personal rights. Along with the effect of the new Civil Code is also planned to amend the relevant procedural rules. For deciding on the moral rights and any claim arising from them are newly in the first instance of the County Courts.
