Smlouva o běžném účtu Tématem této diplomové práce je problematika smlouvy o běžném účtu. Cílem této práce je exkurz do právní úpravy předešlé, především však analýza platné a účinné právní úpravy dle právního řádu České republiky. Hlavním zaměřením je porovnání právní úpravy smlouvy o běžném účtu v obchodním zákoníku s právní úpravou platebních služeb v zákoně o platebním styku, neboť právě tento zákon přinesl významné změny do úpravy platebních služeb, potažmo běžného účtu. Práce je rozdělena do deseti kapitol. V úvodních dvou kapitolách je obsažen všeobecný úvod do problematiky běžného účtu a je zde akcentována jeho důležitost v každodenním životě. Třetí kapitola pojímá základní právní charakteristiku smlouvy o běžném účtu podle platných a účinných právních předpisů v době odevzdání práce a dále je její součástí vývoj právní úpravy do současnosti. Čtvrtá kapitola pojednává o subjektech smlouvy o běžném účtu a je systematicky rozdělena do několika podkapitol, a to s ohledem na charakter toho kterého subjektu. V této kapitole je o subjektech pojednáno komplexně z pohledu jak obchodního zákoníku, tak zákona o platebním styku. V páté kapitole je pojednáno o náležitostech smlouvy o běžném účtu. První podkapitola obsahuje obligatorní náležitosti smlouvy o běžném účtu, zatímco druhá podkapitola se... Current Account Contract The thesis focuses on the matter of a current account. The aim of the thesis is an excursion to the previous legislation, but primarily an analysis of the current applicable and effective legislation of the Czech Republic. The main goal is a comparison of the regulation of a curent account in the Commercial Code with the regulation in the "Payment System Act", since this act brought significant changes to the adjustment of payment systems. The thesis is divided into ten chapters. The first two chapters provide a general introduction of a current account and describes the importance of a current account in an everyday life. Chapter Three presents general legal characteristic of the Current Account Agreement according to the applicable and effective legislation at the moment of thesis handover and also contains the evolution of the related legislation. Chapter Four is dedicated to the subjects of the Current Account Agreement. This chapter offers a comprehensive view on the subject from the perspective of the Commercial Code and the Payment System Act as well. Chapter Five discusses the requirements of a current account.
