Tato diplomová práce se zabývá dnes stále aktuálním fenoménem zvaným stalking, a to nejen jeho závažnější podobou, tedy nebezpečným pronásledováním, ale i jeho podobami lehčími. Práce je systematicky členěna do tří stěžejních částí - první část se zaměřuje na vymezení pojmu, následuje část zabývající se trestněprávními hledisky a poslední z nich je věnována aspektům kriminologickým. Úvodní kapitola obsahuje některé z nejznámějších definic, snaží se vymezit rozdíl mezi stalkingem a nebezpečným pronásledováním a zároveň také čtenáře stručně seznamuje s jeho historií a možnými podobami tak, aby mohl tento problém v obecné rovině pochopit. Druhá část je věnována trestněprávní rovině stalkingu. Podrobněji se zaměřuje na poměrně zajímavý proces zakomponování přečinu nebezpečného pronásledování do právního řádu České republiky a také podává výčet možností postihu stalkera před přijetím antistalkingové legislativy, tedy před rokem 2009. Zároveň je v tomto druhém celku komplexně analyzována skutková podstata dle ustanovení § 354 TZ, jež je porovnána i se zahraničními úpravami, ve kterých našla určitou inspiraci a samozřejmě zde nechybí ani analýza judikatury Nejvyššího soudu. V neposlední řadě druhá část také přináší ucelený výčet sankcí, jež lze pachateli za tento přečin uložit. Poslední celek pojednává... This dissertation deals with today still actual phenomenon called stalking, not only with it's more serious form known as a dangerous stalking but even its less serious forms. The work is systematically divided into three key parts - the first one focuses on a term definition followed by the part dealing with criminal points of view and the last one concentrates on criminological aspects. The introductory chapter contains some of the most famous definitions trying to define a difference between a stalking and a dangerous stalking. The readers are as well informed about the history of stalking and its possible forms to make it easy to understand the problem on a common level. The second part is dedicated to a criminal level of stalking. It detailly focuses on a quite interesting process of incorporation of a dangerous stalking offence into a law system of the Czech Republic. It also provides a list of possible sanctions of a stalker before an antistalking legislation introduction (it means before the year 2009). The second part of my work deals with a complex analysis of facts of the case according to the enactment §354 of the Criminal Law that is compared with some foreign norms in which it has found an inspiration.
