Cílem této diplomové práce je identifikovat nejčastější a nejzávažnější pochybení zadavatelů veřejných zakázek vyskytující se v rozhodovací praxi Úřadu pro ochranu hospodářské soutěže a na základě údajů o počtech těchto pochybení v uplynulých letech a o připravované legislativní úpravě v oblasti veřejných zakázek odhadnout další vývoj v počtech a závažnosti pochybení zadavatelů veřejných zakázek. V případě zjištění pravděpodobnosti negativního vývoje bude rovněž navrženo vhodné zaměření dalších legislativních změn tak, aby byla posílena ochrana zásad transparentnosti, rovného zacházení a nediskriminace a aby bylo dosaženo hospodárnějšího vynakládání veřejných prostředků. Diplomová práce se skládá z osmi kapitol, z nichž každá se zabývá specifickými aspekty pochybení zadavatelů veřejných zakázek. První kapitola je úvodní. Druhá kapitola popisuje postup, jakým je s rozhodnutími Úřadu pro ochranu hospodářské soutěže v této diplomové práci pracováno. Třetí kapitola stručně pojednává o historii Úřadu pro ochranu hospodářské soutěže jako orgánu dohledu nad dodržováním zákona o veřejných zakázkách a tedy i jako hlavního informačního zdroje celé práce. Čtvrtá kapitola je dělena na pět částí, z nichž každá se podrobněji věnuje jedné z pravomocí, které Úřadu pro ochranu hospodářské soutěže zákon o veřejných... The purpose of this thesis is to identify the most common and the most severe deficiencies in the conduct of the contracting authorities in the case law of the Office for the Protection of Competition and based on the data about numbers of these deficiencies in the past years and by taking into consideration the proposed legislative changes forecast the future development in the numbers and severity of the deficiencies in the conduct of the contracting authorities. In case of an adverse forecast correct aim of future legislative changes will be suggested so that the principles of transparency, equal treatment and non-discrimination would be protected and more efficient use of public funds would be ensured. The thesis is composed of eight chapters, each of them dealing with different aspects of the deficiencies of the contracting authorities. Chapter One is introductory. Chapter Two describes how the case law of the Office for the Protection of Competition was researched and used in this thesis. Chapter Three briefly describes the history of the Office for the Protection of Competition as the body which supervises the adherence to the Act on Public Procurement and as such provides the main source of case law and information for this thesis.
