ALTERNATIVY NEPODMÍNENĚHO TRESTU ODNĚTÍ SVOBODY Pavlína Sýkorová Má diplomová práce se zabývá alternativními tresty, jež mohou být uloženy namísto nepodmíněného trestu odnětí svobody. Práce je rozdělena do šesti kapitol. V úvodu práce se zabývám obecnými otázkami trestání, kdy objasňuji pojem trestu a jeho účel. Rovněž nastiňuji koncept restorativní justice, která představuje základ alternativních přístupů v trestním právu. Druhá kapitola popisuje systém a formy alternativního řešení trestních věcí, jejich historický vývoj v České republice po roce 1989 a činnost mezinárodních organizací v této oblasti, zvláště Organizace spojených národů a Rady Evropy. V této části také představuji instituci a činnost Probační a mediační služby, která sehrává důležitou roli během ukládání a výkonu některých alternativních trestů. Hlavní pozornost je v této práci zaměřena na kapitoly 3 až 6, jež se věnují jednotlivým alternativním trestům v platné české úpravě, jejich ukládání a výkonu. Postupně se zabývám institutem podmíněného odsouzení, trestem obecně prospěšných prací, peněžitým trestem a trestem domácího vězení. Závěrečné podkapitoly této části srovnávají českou a francouzskou úpravu alternativních trestů a jejich praktickou aplikaci. V této části rovněž vyjadřuji návrhy úpravy de lege ferenda. . ALTERNATIVES TO UNCONDITIONAL IMPRISONMENT Pavlína Sýkorová My diploma thesis deals with alternative punishments which may be imposed as an alternative to imprisonment. The thesis is divided into six chapters. In the introduction of my thesis first I deal with general issues, I define the term and the purpose of punishment and I outline the concept of Restorative justice which presents the base of alternative approaches in the penal law. The second chapter describes the system and various forms of alternative sentences and criminal procedure alternatives (procedural diversions), their historical development in the Czech Republic since 1989 and the activity of international organisations in this domain, especially United Nations and The Council of Europe. In this chapter I also present the institution and characterise the activity of the Probation and Mediation Service which has an important role during the imposition and execution of some alternative punishments. The main attention in the thesis is concentrated on the chapters 3 to 6 which concern particular alternative forms of punishment in the valid and effective Czech legislation, their imposition and execution.
