[cze][eng] Není to dlouho, co Newyorská úmluva o uznání a výkonu cizích rozhodčích nálezů z roku 1958 (dále jen Newyorská úmluva nebo NÚ) oslavila půl století své existence. To sebou přineslo mimo jiné i polemizování o její efektivnosti a přínosech. Hlavním cílem této práce je zhodnotit, zda je Newyorská úmluva ve stávající podobě dostačující pro dnešní formy mezinárodního obchodu nebo nikoli. Současně se také tato práce zabývá otázkou, zda může být možným řešením vznik Mezinárodního odvolacího rozhodčího tribunálu. Není pochyb o tom, že Newyorská úmluva byla a je obrovským přínosem pro obchodní arbitráže. Ale jedním z hlavních faktorů, které stojí za upozornění je, že tato úmluva je více než půl století stará, a tudíž se musí uzpůsobit nynějším trendům v mezinárodním obchodu. Bylo by nesprávné upírat Newyorské úmluvě její zásluhy, ale je sporné, zda i v dnešní době plní tu samou funkci jako na jejím začátku. Jak se měnil čas, měnily se i obchodní zvyklosti, a tudíž se musí změnit i pravidla arbitráží tak, aby byla schopná efektivně rozhodovat o současných sporech. K pochopení přínosu a potřebné změny Newyorské úmluvy je zapotřebí vysvětlit její vznik a vývoj. Tímto se zabývá první kapitola této práce. Druhá kapitola se věnuje rozhodčímu řízení v České republice. Kapitola tři až šest odpoví na otázky, proč není...The main aim of this thesis was to discuss whether the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (NYC) is satisfactory and whether it can still fulfil the needs of modern business practises, or if it needs reform. The discussion whether the NYC is or is not in need of reform was carried out though examples of decided cases. This paper does not doubt the importance of the NYC, it appreciates that it is one of the most effective and successful treaties ever created in the entire history of commercial arbitration, if not in the whole field of rule of law. It had accomplished its goals in simplifying the whole process of enforcing foreign awards but, as the discussion in this paper suggests, NYC is not satisfying the business needs anymore. This is mainly due to the vague interpretation of various provisions within the NYC, which are not specifically addressed as to their meaning. The paper focuses on three articles, namely Article I, II and V, as those ones are the most troublesome. Those three articles provide the biggest lacuna and possibilities for interpreting judges' discretions of what they feel should be the meaning of certain NYC provisions. The discussion in this paper further shows that municipal courts are interpreting the NYC as they think best fits the facts...
