Rigorózní práce sleduje jak historický vývoj úlohy důkazů a dokazování v civilním procesu, tak aktuální právní úpravu důkazního řízení před občanskoprávními soudy. Práce se věnuje popisu základních principů občanského soudního řízení, souvisejících s dokazováním, charakteristice jednotlivých důkazních prostředků a samotnému průběhu dokazování před soudy I. a II. stupně. Práce se zabývá také dopadem novely č. 7/2009 o.s.ř., která zásadním způsobem zasáhla do podmínek provádění důkazů v českém civilním procesu, a neopomíjí ani téma zajištění důkazů ve věcech civilních v rámci EU. This paper focuses both on the development of the historical role of evidence and proof in a civil trial and the current rules of evidence before the civil courts. The work deals with the description of the fundamental principles of civil procedure relating to the evidence, the individual characteristics of evidence and the evidence itself before the Court of the First Instance and the Court of the Second Instance. The paper also describes the impact of the amendment no. 7 / 2009 of the civil procedure code, which has significantly affected the conditions of evidence in the Czech civil trial and does not miss out the issue as evidence in civil matters within the EU.
