Téma této práce jsem si zvolil proto, že mě stavebnictví a s ním související problematika zajímá. Dalším důvodem pro výběr tématu práce je, že stavebnictví je velmi perspektivní, dynamicky se rozvíjející a lukrativní obor. Práce začíná historickým úvodem do problematiky stavebního práva a jeho hlavními vývojovými mezníky na území České republiky. V následující pasáži první kapitoly jsou detailně rozebrány prameny veřejného stavebního práva. Základní pojmy stavebního práva, důležité pro zpracování předložené diplomové práce jsou definovány v kapitole 2. Problematika výkonu veřejné správy, která souvisí s prováděním staveb, je popsána v kapitole 3. Režimy realizace staveb jsou popsány v kapitole 4. První je tzv. "volný" režim, který je využíván v případě technologicky méně náročných záměrů a nejméně zasahujících do veřejných a soukromých zájmů (podkapitola 4. 1.). Druhý je ohlašovací režim a institut územně plánovací informace je uveden v podkapitole 4. 2. A třetí, nejvíce důležitý, povolovací režim. V povolovacím režimu jsou prováděny všechny stavby, pokud není stanoveno, že postačuje ohlašovací nebo "volný" režim. Alternativám stavebního povolení jsou věnovány samostatné podkapitoly. Veřejnoprávní smlouvy (4. 4.) a certifikát autorizovaného inspektora (4. 5.) Závěrečná 5. kapitola pojednává o... I have chosen this topic, because I am interested in building and related issues. Another reason for the selection of the work is that the construction industry is very promising, dynamic and lucrative field. The thesis is devided into five chapters with appendix. The work begins with a historical introduction to construction law and its major developmental milestones in the Czech Republic. The sources of public constructional law are discussed in detail in the following passage of the first chapter. Basic terms of construction law, relevant to the processing of the dissertation are defined in chapter 2. The issue of public administration that is related to the construction is described in chapter 3. Realization modes are described in chapter 4. First is called "free" mode, which is used in case of less technologically challenging projects and a minimum of intervening in the public and private interests (chapter 4.1). Second is the reporting regime and institute planning information given in section 4.2. And third, I consider the most important an authorization regime. In the authorization regime are carried out all constructions, if is not established that the reporting regime is sufficient or "free".
