Ve své práci se zabývám autorskoprávní ochranou v hudebním průmyslu. Zaměřuji se především na popis autorských práv, práv souvisejících s právem autorským, kolektivní správu a ochranu těchto práv. Nejdříve uvádím vnitrostátní, mezinárodní a evropské prameny autorského práva a vysvětluji pojmy autorské právo, autorské dílo (včetně díla hudebního a díla zpracovaného) a autorství. Dále se zabývám autorským právem z hlediska jeho vzniku, obsahu a omezení. Autorské právo je založeno na kvazidualistické koncepci, což zjednodušeně znamená, že se rozlišují práva osobnostní a majetkové povahy. Ve své práci se zabývám vysvětlením obsahu všech těchto jednotlivých práv. Věnuji se úpravě licenční smlouvy, kterou autor opravňuje jinou osobu k výkonu práva užít jeho dílo. Zaměřuji se i na případy tzv. mimosmluvního užití děl, což znamená, že uživatel smí dílo užít bez souhlasu autora a bezplatně. Dále se věnuji vymezení pojmů a obsahu práv výkonného umělce k jeho uměleckému výkonu, výrobce zvukového a zvukově obrazového záznamu k jeho záznamu a rozhlasového a televizního vysílatele k jeho vysílání. Dále se zaměřuji na činnost kolektivních správců a v závěru se věnuji soukromoprávní a veřejnoprávní ochraně poskytované autorským právům a právům souvisejícím s právem autorským. In this work, the copyright protection in the music industry is discussed. I am focusing in particular on the description of copyright, rights related to copyright, collective management and protection of these rights. In the beginning, I mention the national, international and European sources of copyright and I am explaining the concepts of copyright, copyright work (including musical and processed work of art), and authoring. Furthermore, I explore the copyright law in terms of its origin, content and restrictions. Copyright is based on the quasidual concept, which simply means that we distinguish the moral rights from the property rights. In this work, I explain the content of all of these individual rights. I also address the licensing contract, by which the author authorizes another person to administer the rights to use his piece. I am focusing on cases of the so-called non-contractual use of production, which means that the user may use the work without the consent of the author and free of charge. Furthermore, I define the idea and the content of performer's rights to his artistic output, the manufacturer of the sound and image recording rights to his sound recordings and radio and television broadcaster's rights to his broadcast.
