Jako téma své diplomové práce jsem zvolila Srovnávací reklamu a vývoj její úpravy v českém právním řádu. Na první pohled téma spíše ekonomické má i velice silný právní rozměr. V této práci bych se ráda zaměřila na skutečnou úlohu srovnávací reklamy v českém právním řádu a možnosti jejího budoucího vývoje. Tuto práci jsem koncipovala do šesti částí. Úvod je částí první a definuje cíle této práce. V části druhé jsem se zaměřila na obecné vymezení pojmu reklama. Snažila jsem se o výklad její definice z pohledu vlivu komunitární úpravy. Dále jsem se pokusila srovnávací reklamu kategorizovat a zároveň vymezit, co již za srovnávací reklamu považovat nemůžeme. V této souvislosti jsem krátce přiblížila problematiku superlativní a dryáčnické reklamy. Velice důležitá kapitola části druhé je věnováná etice, jelikož reklama je nejen institutem ekonomickým, nebo právním, ale z pohledu příjemce reklamy je především institutem psychologickým a sociologickým. Z toho důvodu jsem se v této kapitole zaměřila i na etické vnímání reklamy. V části třetí jsem se snažila pouze nastínit právní předpis přijatý v době 1. Československé republiky, ze kterého vychází dnešní podstata nekalosoutěžního jednání, tedy zákon proti nekalé soutěži č. 111/ 1927 Sb. z. a n. Jeho existence je pro toto téma velice důležitá , a to i... - Comparative Advertisement - the development of regulation in the Czech legal order The topic of this thesis is Comparative Advertisement - the development of regulation in the Czech legal order. The thesis is composed of six parts. Part One is introductory and identifies the goals of this thesis. Part two deals with the concept of advertising in general. I defined various categories of comparative advertising as well as various other types of advertising that can-not be considered as comparative. I described also superlative advertising and its aspects as well as the special term " dryáčnická" advertisement, which is a rather humurous section of the Part Two of this thesis. Part Three describes the history of comparative advertising in the first Czechoslovak republic ( i.e. in the period between 1918 and 1938), nevertheless the term " comparative advertising" in today's meaning cannot yet be used in this period. When writing the Part Three, I focused mainly on the Act against Unfair Competition of 1927, and on interesting case law from this period. I also focused on unfair competition in connection with misleading advertising in this period as well as on the no more existing Aero car brand advertising that can be considered as a good example of what is today called comparative advertising.
