TYMOFEYEVA, A. Přistup k nezávislému a nestrannému soudu jako záruka spravedlivého řízení podle Evropské úmluvy o lidských právech. Praha 2010. Disertační práce. Univerzita Karlova v Praze. Právnická fakulta. Katedra mezinárodního práva. Vedoucí práce Doc. PhDr. Stanislava Hýbnerová, CSc. Práce se zabývá právem na přístup k nezávislému a nestrannému soudu podle ustanovení Evropské úmluvy o lidských právech se zaměřením na soulad legislativy a soudní praxe na Ukrajině se standardy, vypracovanými v judikatuře Evropského soudu pro lidská práva. V rámci řešení této problematiky je v první části práce proveden rozbor pojmu "právo na přístup k soudu" a jeho jednotlivých prvků. Z analýzy judikatury Evropského soudu vyplývá, že pojem "právo na přístup k soudu" zahrnuje následující prvky: 1) právo na zahájení soudního řízení, včetně odvolání a dovolání proti rozhodnutí správního nebo soudního orgánu v určitých případech; 2) právo na poskytování právní pomoci, včetně přidělení advokáta z úřední moci a osvobození od poplatků; 3) právo na projednání stížnosti nezávislým, nestranným soudním orgánem s plnou jurisdikcí, zřízeným zákonem; 4) právo na rozhodování soudu a vydání rozsudku v přiměřené lhůtě a 5) právo na výkon pravomocného a závazného soudního rozhodnutí v přiměřené lhůtě. The paper discusses the right of access to an independent and impartial tribunal under the European Convention on Human Rights with a focus on compliance of legislation and judicial practice in Ukraine with the standards developed by the European Court of Human Rights in its case-law. In order to address this issue the first part contains an analysis of the term "right of access to a court" and its components. An analysis of the term "right of access to a court" in a sense of the European Convention shows, that it includes the following elements: 1) the right to institute the legal proceedings and, in certain cases, the right to appeal against a decision of an administrative body or a court; 2) the right to legal aid, including free legal assistance and exemption from the court's costs; 3) the right to hearing by an independent and impartial tribunal with full jurisdiction established by law; 4) the right to hearing and delivery of the court's decision within a reasonable time and 5) the right to...
