Závěr Úmluva na ochranu lidských práv a důstojnosti lidské bytosti v souvislosti s aplikací biologie a medicíny je relativně novou právní úpravou, která se snaží komplexně upravit otázky, které se objevily v souvislosti s rozvojem biologie, medicíny, biotechnologií. Jedná se o poměrně širokou a technicky složitou oblast, kterou se Úmluva snaží regulovat. Není samozřejmě v silách Úmluvy a musíme si přiznat, že se o to ani nesnaží, aby obsáhla veškeré detaily a různé nuance zkoumaných otázek. Omezuje se tak na pouhé zakotvení základních myšlenek a zásad týkajících se zdravotní péče. Jejich další konkretizování a rozvinutí nechává buď na svých dodatkových protokolech nebo na vnitrostátní úpravě. Cílem Úmluvy je tedy zajištění určitého minimálního standardu, který chrání a který má být dále rozvíjen. Cílem této kapitoly je krátké shrnutí poznatků, ke kterým bylo během diplomové práce dospěno, a zhodnocení přínosu přijetí Úmluvy o biomedicíně v České republice. V diplomové práci jsem se postupně zabývala všemi oblastmi, které Úmluva o biomedicíně upravuje, uvedla způsob, jakým je konkrétní oblast v Úmluvě řešena, a následně zhodnotila i českou právní úpravu týkající se dané oblasti. Úmluva o biomedicíně je jistě v oblasti zdravotní péče a zdravotnického práva velkým přínosem. Mezi největší přínos Úmluvy patří... The Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine. Abstract The main purpose of my thesis is to analyse The Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine. Author's main focus is determined by the title of the thesis and she mainly concentrates on individual provisions of the Convention on Human Rights and Biomedicine and their incorporation in Czech law and order. The thesis is composed of introduction, three chapters and conclusion. Chapter one deals with medical law. It defines medical law and describes legal rules relating to health care. Chapter two generally describes The Convention on Human Rights and Biomedicine. It is subdivided into four sections dealing with reasons of creation and aims of this Convention, bioethics and medical experiments. Chapter Three is the most comprehensive. It contains fourteen parts. These subchapters describe particular provisions and chapters of the Convention and their regulation in Czech legal system. Conclusions are drawn in the last chapter. The main aim of the thesis was to analyse the Convention on Human Rights and Biomedicine and its benefit and influence on Czech legal system. Author recommends...
