Závěr Společensky reflektovaným problémem se domácí násilí v ČR stalo teprve tehdy, když se ženským organizacím podařilo prosadit tento dlouho neřešený sociálně patologický jev jako mediální téma a pojmově vymezit jako nevyprovokované, opakované, gradující násilné jednání ze strany násilné osoby, které vzbuzuje strach v osobě (osobách) ohrožených, a role obou zúčastněných stran jsou v intimním (rodinném) vztahu jasně a neměně určeny. Do té doby se o domácím násilí oficiálně nehovořilo.1 Po několikaletých odborných diskuzích a po sérii mediálních akcí bylo docíleno společenského konsensu, jehož výsledkem byla v roce 2004 kriminalizace domácího násilí v podobě nového trestného činu "Týrání osoby žijící ve společně obývaném bytě nebo domě nebo osoby blízké" podle § 215a TrZ (zákon č. 140/1961 Sb.) a o tři roky později přijetí zákona č. 135/2006 Sb., kterým se mění některé zákony v oblasti ochrany před domácím násilím, který nabyl účinnosti dne 1. 1. 2007.2 Od 1. 1. 2010 vstoupil v účinnost také nový trestní zákoník, který přinesl mnohé změny a to nejen v oblasti domácího násilí. Nicméně pro oblast domácího násilí je jistě největší pozitivní změnou zavedení nového trestného činu "Nebezpečné pronásledování" podle § 354 TrZ, který postihuje nebezpečný stalking tj. pronásledování, nejčastěji ze strany bývalého... A victim of domestic violence and the possibilitics of the victim's protection under criminal law. Abstract: For my thesis, I have chosen the topic of Victim of domestic violence and the possibility of criminal protection after finishing an elective course "Domestic violence" mainly because I have found this issue very intriguing. I do not deal with the whole issue of domestic violence in my thesis. In the first part, I summarize theoretical knowledge about domestic violence and in the second part, concerned with legal regulations, I address especially the summarization of present legal regulations and the identification of their shortcomings. The thesis is divided into nine chapters, where the first one is the introduction and the last one is the conclusion. Thematically oriented chapters follow the first one. The first chapter is devoted to the notion of violence itself, specifically domestic violence. Types and forms of domestic violence follow and even myths about domestic violence are not omitted. Since my thesis is titled "Victim of domestic violence…", I cannot but to mention in the next chapter victimology, discipline dealing with the victims of the crime and related phenomena (victimhood, victimization, etc.).
