Závěr Správa spotřebních daní může nežádoucím způsobem omezit obchod a tím hospodářský rozmach členských zemí. Proto by se do budoucna měla zavádět taková pravidla, která co nejvíce šetří volný pohyb zboží, přičemž zároveň zlepšují možnosti jeho kontroly. Domnívám se, že velkým krokem v před je zavedení nového systému EMCS, který zavede novou elektronickou podobu dokumentů a bude jistě znamenat zjednodušení pro obchodníky i samotné správce daně. Nová horizontální směrnice 2008/118/ES, která tento systém zavádí, je v mnohém přehlednější a pokrokovější než stará právní úprava, ale bude jistě záležet hlavně na tom, jak se podaří členským zemím implementovat její obsah do národních právních řádů tak, aby byly sladěny požadavky EU i členských států. Členské země by se měly snažit začlenit unijní předpisy do svých národních právních řádů tak, aby byl celý systém pro občany přehledný a srozumitelný. Troufám si tvrdit, současné nastavení celého systému jednoduché není a mnohdy představuje pro podnikatele neadekvátní zátěž. Velmi pozitivní je spolupráce členských zemí na správě spotřebních daní a boji proti daňovým únikům, která se po zrušení vnitřních hraničních kontrol ukázala jako nezbytná. Jako velmi zdařilý hodnotím zejména program Fiscalis, který pomáhá organizovat a financovat vzájemnou spolupráci daňových... Resumé / Summary Excise duties on alcohol and alcohol beverages in Community law The main topics of my thesis are excise duties and administrative aspects relating to them. Czech Republic joined the European Union in 2004. The EU begun the integration to achieve political power and economic prosperity. To achieve that prosperity could be complicated due to obstructions of free movement of products created by demands on administration of excise duties. I decided to focus on excise duties, especially the excise duty applied on alcohol and alcohol beverages. The aim of this publication is to describe the EU legislation of excise duty as well as to identify and describe problems arising from that particular area of law. I also paid attention to problems concerning implementation of the EU legislation into Member States law including Czech Republic. In the first chapter we can find a definition of a tax, its characteristics and classification from different points of view, after that also more detailed description of features of an indirect taxation. In the second chapter I have attempted to define the concepts of coordination, harmonization and competition in tax field and then evaluate their advantages and disadvantages in comparison.
