[cze][eng] 10. Závěrečné shrnutí Téma této diplomové práce spadá do oblasti autorského práva, které zaznamenává v posledních letech výrazný vývoj. V roce 2000 byl přijat nový český autorský zákon, jenž znamenal nezbytnou rekodifikaci autorského práva u nás a který byl již několikrát novelizován, v mezinárodní oblasti byly přijaty dvě univerzální smlouvy Světové organizace duševního vlastnictví a v neposlední řadě se Česká republika přidružila v roce 2004 k Evropské unii, což pro oblast autorského práva znamenalo, že bylo třeba harmonizovat český právní řád se směrnicemi komunitárního práva. S postupem doby se stává autorskoprávní oblast stále více propracovanější, k čemuž dává příčinu neustálý rozvoj společnosti, nové technologie a podstatné rozšiřování způsobů a možností užití výsledků tvůrčí činnosti autora. Několikrát je v této práci zmiňováno, že v současné právní úpravě došlo ke změně základní koncepce z původní monistické na dualistickou, což znamená, že osobní a majetková práva autora dnes tvoří dva oddělené celky. V návaznosti na snahy o harmonizaci českých a komunitárních právních předpisů došlo k posílení právní jistoty subjektů autorskoprávních vztahů, autoři jsou lépe chráněni a zákon respektuje nejen zájmy jejich, ale taktéž zájmy uživatelů autorských děl. Závěrečné shrnutí v anglickém jazyce Conclusion The topic of this degree work features copyright, which is developing very fast during the past years. In the year 2000 a new Copyright Act was enacted, which meant a necessary recodification of copyright in Czech Republic and already was amended many times. In the international copyright territory were enacted two universal contracts by the World Intellectual Property Organization (WIPO). In the year 2004 Czech Republic joined the European Union, which meant a harmonization of Czech Law with Community Law. In the course of time the copyright spere is more and more well-developed, which is caused by the society evolution, new technologies and the possibilities of use of the results of the author's creative activity. A major change has been made in the contemporary legislation concerning the change from the monistic law conception to the dualistic law conception, resulting the separation of personal rights and proprietary rights. In effort to harmonize the Czech Law with the Community Law a reinforcement has been made of the legal certainty of copyright subjects.
