74 Záv r V dnešní "otev ené" Evrop má jednotná úprava unifikující kolizní normy smluvního závazkového práva ur it své místo. Mnoho z nás uzavírá obchody, které p esahují hranice stát . Pro zvýšení právní jistoty je p ínosné aplikovat ve všech státech Evropské unie stejná pravidla pro ur ování rozhodného práva pro smluvní závazky. Na druhou stranu neexistuje právní p edpis, který by vylou il nejasnosti nebo možnosti odlišného výkladu. S ohledem na r znost p ístup jednotlivých len EU k právu, je nutné si uv domit, že jak ímská úmluva, tak Na ízení ím I jsou dílem právní komparatistiky a zárove výsledkem kompromis a ústupk . Platí, že n které instituty jsou v Ú a v Na ízení ím I upraveny odlišn - zejména drobné úpravy v cné p sobnosti, podoba volby práva, institut smluv souvisejících s jedinou zemí a obecné otázky MPS. Nejv tší zm ny nastaly v oblasti náhradních hrani ních ur ovatel p i neexistenci volby práva a v úprav smluv se slabší smluvní stranou, jenž je však celkem nep ehledná a dosti kazuistická. Smluvní autonomie ovládá oba instrumenty v celém jejich zn ní, s výjimkou ochrany slabší smluvní strany a klasických institut MPS jako jsou ve ejný po ádek i imperativní normy. Zm ny provedené v Na ízení ím I nejvíce vedly snahy o up esn ní otázek, které ne zcela p esv d iv byly vy ešeny v ímské úmluv nebo... 79 Summary The purpose of my thesis is to analyse Rome Convention and Rome I Regulation and find out the differences between them. The reason for my research is arising amount of contracts with international elements and my interest in European Private International Law. The thesis is composed of three parts, each of them dealing with different aspects of the problem. Part One is introductory and defines basic terminology used in the thesis. The part is subdivided into two chapters. Chapter One describes Private International Law and explains the notion, methods of regulation, conflict rules and connecting factors in general and choice of law. Chapter Two deals with the notion European Private International Law, its meaning, and its sources of law and discusses application of Private International Law. Part Two compares particular legal institutes of Convention and Regulation except contracts with weaker contractual party. The Part consists of eight chapters. They are focused on legal base, applicability, international element, statutes of obligation and its limitations, some questions of International Private Law, role of Court of Justice, relationship to other legal tools, and special position of some member states. Part Three is subdivided into two chapters and summarized all knowledge. Chapter One...
