[cze][eng] Cílem této práce na téma Přístup k soudům ve věcech ochrany životního prostředí je popis možností přístupu fyzických a právnických osob k soudní ochraně životního prostředí v České republice. Soudní ochrana je důležitým prvkem pro zajištění práva na příznivé životní prostředí. Pro efektivní zajištění ochrany životního prostředí a práva jednotlivců na jejich příznivé životní prostředí je nutné zajistit co nejširší přístup fyzických a právnických osob k jednotlivým soudním orgánům k možnosti namítání nezákonností ze strany orgánů veřejné moci či třetích osob. Široká soudní ochrana práva na příznivé životní prostředí je nezbytnou a nepostradatelnou součástí demokratického zřízení a základním předpokladem pro fungování tohoto základního lidského práva v praxi. Tato práce se nejprve musí zabývat hmotně právní otázkou práva na příznivé životní prostředí - jeho obsahem a okruhem subjektů, kterým toto základní ústavní právo přináleží. Právem na příznivé životní prostředí se rozumí právo na takové prostředí, které je antropogenně zatěžované pouze podlimitně. Tedy na prostředí znečišťované a zatěžované důsledky lidské činnosti včetně vnášení fyzikálních, chemických či biologických emisí a činitelů v míře, jíž připouštějí jednotlivé složkové předpisy na ochranu životního předpisy a lidského zdraví. Soudy až...The aim of this work on Access to Justice in Environmental Matters is to describe possibilities of access of natural and legal persons to the judicial protection of the environment in the Czech Republic. Judicial protection is an important element of ensuring the right to favourable environment. To ensure effective environmental protection and the rights of individuals to the favourable environment, it is necessary to ensure the widest possible access of natural and legal persons to public authorities and courts claiming the illegality of decisions, acts and omissions of public authorities or third parties. Broad judicial protection of the right to favourable environment is necessary and indispensable part of democratic system and a prerequisite for the functioning of basic human rights in practice. This work must first address the question of substantive legal right to favourable environment -its content and range of entities to which this fundamental constitutional right belongs. Right to favourable environment means the right to an environment which is polluted below given limit.
