RESUMÉ: Cílem této práce je poskytnout rozsáhlou analýzu institutu konkurenční doložky v pracovním právu v České republice. Tuto práci jsem vybrala, abych mohla podrobněji zkoumat institut konkurenční doložky, posoudit jeho klady a zápory, na základě kterých bude učiněno rozhodnutí, zda současná právní úprava splňuje předpoklady pro uzavření takové dohody, oběma smluvními stranami. Práce je členěna do čtyř kapitol, z nichž každá se zabývá odlišnými aspekty, jež konkurenční doložka přináší, ale také její historií a jejími současnými problémy. První kapitola je kapitolou úvodní a popisuje pojem konkurence, jak obecně, tak i v pracovním právu. Tato kapitola se člení do dvou podkapitol. První z nich popisuje rozdíl mezi konkurencí během pracovního poměru a konkurencí až po skončení pracovního poměru. Druhá část obsahuje popis základní terminologii a stav, ve kterém se konkurenční doložka v našem právním řádu nachází. Třetí kapitola se věnuje historii institutu konkurenční doložky v našem právním řádu a vykresluje průběh, jakým se institut vyvíjel. Kapitola je rozdělena do tří částí. Každá z nich se soustředí na specifické historické období, které vývoj konkurenční doložky provázelo. Třetí kapitola zkoumá konkurenční doložku ve smyslu její současné právní úpravy a skládá se ze čtyř částí. První z nich obsahuje... The aim of the thesis is to be a comprehensive analysis of the non-competition clause in Czech Labour law. The reason for my research is to examine the non-competition clause, compare and contrast its advantages and disadvantages and to make a conclusion, whether the current legislation meets the requirements of both contracting parties. The thesis is composed of four chapters, each of them dealing with different aspects of non-competition clause, its history and its current problems. Chapter One is introductory and describes the competition in general and in Labour law. The chapter is subdivided into two parts. Part One describes the difference between the competition during the employment relationship and after termination of the employment. Part Two describes the basic terminology and the current state of a non-competition clause. Chapter Two focuses on the history of the non-competition clause in our legislation and illustrates the evolution of such institute. This chapter is subdivided into three parts. Each of them focuses on a specific historical period in the evolution of the non-competition clause.
