123 Český abstrakt Rigorózní práce je vedle obligatorního úvodu a závěru členěna do 6 kapitol. Práce se zaměřuje na daňové aspekty insolvenčního řízení, a to jak v rovině procesní, tak hmotněprávní. V rovině procesní je kromě dopadů rozhodnutí o úpadku a probíhající insolvenčního řízení do správy daní řešena rovněž problematika uspokojování daňových pohledávek v rámci insolvenčního řízení. Z hmotněprávní oblasti se práce zaměřuje na ty daně, které se mohou týkat plošně veškerých daňových subjektů, vynechány jsou proto sektorově specifické daně, tj. daně spotřební a ekologické. Po stručném vymezení klíčových pojmů insolvenčního řízení, včetně vymezení jednotlivých kategorií pohledávek, je zařazen popis průběhu insolvenčního řízení a jednotlivých způsobů řešení úpadku. Následující čtyři kapitoly se potom věnují samotným daňovým aspektům insolvenčního řízení. První z nich se zaměřuje na procesní problematiku. Vedle obecných dopadů insolvenčního řízení na probíhající daňová řízení je pozornost věnována mimořádným termínům pro podání daňových tvrzení, která s insolvencí úzce souvisí. Stručně je pojednáno rovněž o ostatních institutech daňového řádu, kterého jsou insolvenčním řízením a úpadkem ovlivněny. The thesis focuses the tax aspects of the insolvency proceedings from both the procedural and substantive perspective. From the procedural point of view, the consequences of bankruptcy and ongoing insolvency proceedings are dealt with. Further the topic of recovery of tax debts is discussed. From substantive law areas, the thesis focuses on the taxes that are relevant generally for all taxpayer. The sector specific taxes such as excise duty and environmental taxes are excluded from this thesis. The brief definition of key terms of insolvency proceedings, including the categorization of receivables, is followed by the description of insolvency proceedings and individual methods of resolving bankruptcy. The following four chapters cover the tax aspects of insolvency proceedings itself. The first of them focuses on the procedural aspects. Firstly, the general consequences of a bankruptcy and insolvency proceedings is addressed. Further, the thesis deals with the deadline for extraordinary submission of tax returns that are closely connected to the bankruptcy.
