[cze][eng] Práce je rozdělena do dvou částí. V první, teoretické části je krátce zmíněna historie nájemní smlouvy, dále aktuální právní úprava a hlavní změny v nájemních smlouvách, které nastaly s příchodem nového občanského zákoníku v roce 2014. Dále jsou v práci uvedeny obecné náležitosti nájemní smlouvy, tedy obecná ustanovení podle občanského zákoníku. Součástí první části je stručná zmínka o jednotlivých nájemních vztazích, kterými jsou nájem prostoru sloužícího podnikání, tedy zvláštní ustanovení o nájmu prostoru sloužícího podnikání (dříve nájem "nebytových prostor"), zvláštní ustanovení o podnikatelském pronájmu movitých věcí, zvláštní ustanovení o nájmu dopravního prostředku a ubytování. Druhá, praktická část je věnována zvláštním ustanovením o nájmu bytu a domu. Na začátku jsou krátce vymezeny základní pojmy týkající se nájmu bytu a domu. Hlavní částí je pak rozbor konkrétní nájemní smlouvy, kterou je jedna z nejčastěji používaných nájemních smluv, a to smlouva o nájmu bytu. Jsou zde popsány a názorně uvedeny jednotlivé články vzorové smlouvy o nájmu bytu, která je součástí této bakalářské práce, a je uvedena v příloze č. 1. Proto by práce dále mohla sloužit jako návod pro ty, kteří chtějí správně uzavřít nájemní smlouvu. The bachelor thesis deals with the topic of lease agreement. By the lease contract the lessor undertakes to leave the matter to the lessee's temporary use, and the lessee agrees to pay a rent to the landlord. The main aim is to introduce the lease contract. The thesis is divided into two parts. The first, teoretical part presents the history of lease agreement, current legislation and the main changes introduced by the Civil Code in 2014. Afterwards, the general requisites of lease agreement are presented. At the end of the first part the individual lease relations commercial lease, business lease of movables, lease of means of transport and accommodation are specified. The second, practical part focuses on special provisions of the lease and rent of an apartment. Firstly, the basic terminology is presented. Secondly, analysis of the lease contract, which is the best known agreement for an apartment lease, is analysed in detail. The analysis involves description and presentation of individual parts of the contract. The thesis may serve as a manual for those who want to conclude a lease.
