Cílem této bakalářské práce je srovnání legislativních úprav elektronického podpisu v České republice a v Německu. Nejprve jsou stručně vyloženy elektronické služby, které veřejná správa nabízí veřejnosti v obou zkoumaných státech, a základní principy technologie elektronického podpisu. Následuje samotné srovnání legislativ. Analyzována je evropská směrnice 1999/93/ES a zákonné úpravy v obou zemích. Ačkoliv tyto úpravy vycházejí ze stejného základu, jímž je směrnice, nachází se v nich také řada rozdílů, které mají význam i pro praxi. V poslední kapitole je vyložen postup zřízení elektronického podpisu běžné fyzické osoby v obou zemích. V Německu jsou kladeny o něco vyšší požadavky na bezpečnost a kvalifikovaný elektronický podpis lze vytvářet pouze s využitím čipových karet. V České republice je to možné i čistě softwarovou cestou a s nižšími náklady. Využívání elektronického podpisu by měly do budoucna v Německu podpořit některé nové projekty v rámci eGovernmentu. V České republice se rozjíždí kontroverzní systém datových schránek, který k elektronické komunikaci přinutí orgány veřejné správy a právnické osoby. The objective of this bachelor thesis is to compare legislations of the electronic signature in the Czech Republic and in Germany. Electronic services provided by public administration to the public in both countries and basic technical principles of the electronic signature are explained at first. The actual comparison of both legislations follows. European directive 1999/93/EC and laws in both countries are analyzed. Although both legislations are based on the directive, there are some differences between them that are important for practice. The last chapter describes the procedure of obtaining the electronic signature for ordinary individuals in both countries. Safety requirements are somewhat higher in Germany as qualified electronic signatures can only be created with the use of smart cards. In the Czech Republic, it is possible to create them just with software tools and at lower costs. Some new projects in the eGovernment should boost the usage of the electronic signature by the public in Germany. In the Czech Republic, a controversial system of electronic data boxes is being started. This system forces public authorities and legal persons to use electronic communication.
