Diplomová práca sa zaoberá komparáciou riešenia úpadku v Českej republike a Slovenskej republike. Insolvenčný zákon a zákon o konkurze a reštrukturalizácii sú aktuálne právne normy, upravujúce vzťah medzi veriteľom, dlžníkom o ostatnými zainteresovanými osobami. Cieľom práce je analýza insolvenčného prostredia a spôsobov riešenia úpadku v oboch štátoch (identifikovať zápory a výhody jednotlivých úprav). Na praktických príkladoch riešenia úpadku analyzovať kľúčové a kritické faktory ovplyvňujúce celý proces ozdravenia podniku. Diplomová práce se zabývá komparaci řešení úpadku v České republice a Slovenské republice. Insolvenční zákon a zákon o konkurzu a restrukturalizaci jsou aktuální právní normy, upravující vztah mezi věřitelem, dlužníkem o ostatními zainteresovanými osobami. Cílem práce je analýza insolvenčního prostředí a způsobů řešení úpadku v obou státech (identifikovat zápory a výhody jednotlivých úprav). Na praktických příkladech řešení úpadku analyzovat klíčové a kritické faktory ovlivňující celý proces ozdravení podniku. The Master thesis provides a comparison of the solution of the bankruptcy in the Czech Republic and in Slovakia. The Insolvency Act and the Act of bankruptcy and restructuralization represent the current legal acts governing the relationship between the creditor, the debtor and the other interested persons. The aim of the thesis is to analyze the insolvency environment and ways of the solution of the bankruptcy in both states (to identify disadvantages and advantages of the particular cases). Furthermore, it aims to analyze the key and critical factors influencing the whole recovery process in the company on the practical examples.
