Komparativní analýza trestněprávní úpravy nekonsensuální pornografie Abstrakt Tato diplomová práce je věnována problematice nekonsensuální pornografie (NCP), známé tako jako revenge porn či image-based sexual abuse. Fenomén zahrnuje různé způsoby vytváření, získávání a sdílení intimních záznamů osoby, která k takovému jednání nedala souhlas. V poslední době se jedná o téma často mediálně skloňované, na které již adresně reaguje řada zahraničních právních řádů, ovšem v České republice se podobné odezvy prozatím nedočkalo. Cílem práce je zanalyzovat trestněprávní relevanci jednotlivých forem tohoto jevu a vyhodnotit, zda současný právní stav před těmito typy jednání poskytuje dostatečnou ochranu, a případně navrhnout úpravy de lege ferenda, které zajistí adekvátní trestněprávní reakci. Pro splnění cíle práce autorka používá kombinace metody deskriptivní, analytické, komparativní a syntetické. Práce je rozdělena do čtyř kapitol. První kapitola vymezuje pojem NCP, její projevy a škodlivé dopady v psychické a sociální sféře obětí, což zahrnuje i pojednání o často přítomné sekundární viktimizaci. Druhá kapitola analyzuje českou právní úpravu optikou jednotlivých forem NCP a ověřuje možnost a efektivitu uplatnění relevantních trestných činů, aby zjistila případné nedostatky současné právní úpravy. Comparative Analysis of Criminal Legal Regulation of Non-Consensual Pornography Abstract This thesis addresses the issue of non-consensual pornography (NCP), commonly known as revenge porn or image-based sexual abuse. The phenomenon encompasses various methods of creating, obtaining, and sharing intimate materials of individuals without their consent. In recent times, it has become a frequently discussed topic in the media, prompting targeted responses from several foreign legal systems. However, the Czech Republic has yet to enact similar measures. The objective of this thesis is to analyze the legal relevance of different forms of this phenomenon and evaluate whether the current legal framework provides sufficient protection against such conduct. Additionally, it aims to propose legislative reforms, if necessary, to ensure an adequate legal response. To achieve these goals, the author employs a combination of descriptive, analytical, comparative, and synthetic methods. The thesis is divided into four chapters. The first chapter defines the concept of NCP, its forms, and the harmful impacts on the psychological and social well-being of victims, including discussions on secondary victimization.
